1. Summary
1.1 On 18 September 2008, Hampshire County Council agreed that a representative of the River Hamble berth and mooring holders should be appointed to the River Hamble Management Committee, to be matched by an additional County Councillor. This report sets out proposed Terms of Reference for the berth and mooring holders representative, and an outline of the proposed appointment process.
2. Recommendation
2.1 That the River Hamble Management Committee approves the proposed Terms of Reference and appointment process for the berth and mooring holders representative.
3. Proposals
3.1 The proposed Terms of Reference at Annex A are self-explanatory, and include background information.
3.2 In the event that there is more than one nominee for the position, an appointment process will be required. It is proposed that the Chairman of the Management Committee should appoint and convene a selection panel (to be Chaired by a member of the Management Committee, but not necessarily consisting entirely of Management Committee members) to short list, interview and appoint the new representative. Selection criteria should be based on the Person Specification contained in the proposed Terms of Reference.
3.3 This new position is non-statutory and there is currently no intention of seeking an amendment to the Harbour Revision Order.
4. Impact Assessments
4.1 The contents of this report do not have a direct impact on the services
provided by the River Hamble Harbour Authority and has not therefore been subject to an Equalities Impact Assessment.
5. Conclusion
5.1 It is important that the Management Committee agrees the Terms of
Reference for this important new position and it is entirely appropriate that the Management Committee should be fully engaged in the selection of the best candidate.

ANNEX A
Terms of Reference for a representative of River Hamble berth holders and mooring holders on the Management Committee
Background
Hampshire County Council, in its role as the River Hamble Harbour Authority, has recently approved a new position on the Management Committee, to represent the interests of the River Hamble berth holders and mooring holders - ie to represent those people who keep a boat on or adjacent to the River Hamble. This document forms the Terms of Reference for this representative.
The Management Committee was established when responsibility for the River Hamble transferred to Hampshire County Council in 1970. It is a statutory body, the role and structure of which is set out in the River Hamble Harbour Revision Order (1969 and subsequent amendments). Its role is to advise the committee of the County Council charged with decision making for the Harbour Authority, namely the Harbour Board, and to scrutinise its decisions.
The Management Committee comprises nine County Councillors (to include the Chairman and Vice-Chairman), and eight other representatives, one appointed by each of the following organisations:
Eastleigh Borough Council, Fareham Borough Council, Winchester City Council, The Royal Yachting Association, The British Marine Federation, Associated British Ports (Southampton), the Association of River Hamble Yacht Clubs and the Hamble River Boatyard and Marina Operator's Association.
This new position is in addition to the eight other representatives and will be balanced by the appointment of an additional County Councillor.
Person Specification
The appointee:
1. May be a member of any relevant organisation or association but will not represent any specific organisation or association.
2. Should be in a position to represent the views of the majority of boat owners on the River.
3. Should have a background which provides an insight into the views of sailing yachtsmen, motor boaters and dinghy sailors.
4. Must be able to demonstrate a viable means of communicating with
his/her 'constituents' so that he/she can faithfully represent their views
and report back to them on proceedings.
5. Should be able to demonstrate previous experience of committee work.
Commitment
The Management Committee meets formally four times per annum, usually on a Friday at a venue close to the River Hamble. Members must attend at least 50% of meetings. There is also an annual half-day river trip for Management Committee and Harbour Board members and an Annual Forum, held on a weekday evening in March each year. Committee members may also be invited to join project-specific working groups on an occasional basis.
Tenure
The position will be filled as soon as possible and will initially run until May 2013, with the option to stand again for a second four year period. No individual will be allowed to serve more than two consecutive terms.
Code of Conduct
In common with all members of the Management Committee and Harbour Board, the berth holders and mooring holders representative will be required to adhere to the Code of Conduct for local authorities.
Remuneration
This position is not remunerated but reasonable travelling expenses can be claimed.
