CONDITIONS: GENERIC CONDITIONS APPLICABLE TO DEVELOPMENT SITE INCLUDING: PLUMLEY WOOD, BURNT HILL, BLUE HAZE, NEA FARM, BLASHFORD |
Commencement: |
1) The development hereby permitted shall be begun before the expiration of three years from the date of this permission. Written notification of the date of commencement shall be sent to the Mineral Planning Authority within 14 days of such commencement. Reason: To comply with Section 91 (as amended) of the Town and Country Planning Act 1990. 2) Fourteen days prior written notice shall be given to the Mineral Planning Authority of the intention to commence preparatory/enabling works across all parts of the site, ie the Plumley Extraction area, Burnt Hill, Nea Farm and Blashford and all related conveyor crossing points and associated works. Reason: To enable the Mineral Planning Authority to monitor and control the development in accordance with the approved plans and to facilitate community liaison with relation to the timing of the development. Reason: To enable the Mineral Planning Authority to monitor and control the development in accordance with the approved plans and to facilitate community liaison with relation to the timing of the development. Timescale: |
4) The development hereby approved shall cease by 31 December 2025 and the associated plant, conveyor (and associated equipment and machinery), pipelines, cables, hardstandings, buildings and offices be removed within 12 months of the cessation of extraction at Plumley Wood; and the land at Plumley Wood, Burnt Hill, Nea Farm Quarry and Blashford and the conveyor route and bridge shall be restored in accordance with plans approved by way of this certificate: to agriculture, forestry, footpaths and nature conservation at Plumley Wood and Farm; to nature conservation at Burnt Hill; to grazing and parkland at Nea Farm; to original landform and land-use in case of conveyor route, and to a combination of agriculture, woodland, nature conservation and footpaths at Blashford. The total restoration of all areas shall be completed by 31 December 2026 in accordance with plans and documents approved by way of this planning permission and controlled by associated conditions with the exception of the silt ponds at Plumley Farm which shall be finally restored post 2025 in accordance with the approved working scheme and timetable as detailed in Condition 4. Reason: To comply with schedule five of the Town and Country Planning Act 1990, and to minimise the duration of disturbance from the operations hereby approved. Working Programme 5) The site shall be worked in accordance with revised Working and Phasing plans B58/286-299 and in accordance with the report by Land and Minerals Consulting Limited `Phased Working and Restoration Proposals' (8 September 2008), which includes a revised operational timeline Revision 1 Table 4 (dated 8 September 2008) and in accordance with restoration Drawings B58/305A and B58/306A. The Land and Mineral Consulting Limited report includes the phasing of the preliminary Enabling Works which are to be undertaken in accordance with this document which are to be undertaken in accordance with B58/28A-B58/289 and Block Phasing Plan B58/286A. |
Reason: To ensure the development is implemented with minimal disruption to local residents and users of local nearby public footpath and without any significant adverse impacts to the natural environment. |
6) There shall be a minimum of 100 metres stand-off margins to the Blashford Plant site and Plumley Wood Extraction zone from the nearest noise sensitive properties as shown on Plan No. B58/305A/306A and B58325. Reason: In the interests of local amenities. |
Noise |
7) Best Available Techniques (BAT) shall be used at all times to reduce the impact of noise from all operations and activities, including plant, equipment, vehicles and machinery on the nearest residential properties and the nearby public rights of way. Reason: In the interests of local amenities. |
8) Except for Burnt Hill, Noise emitted from temporary works associated with site preparation, including the stripping and movement of any soil and the construction of earth bunds, shall not exceed 70 dB LAeq 1 hour (free field) at the boundary of any noise sensitive premises for more than eight weeks in any calendar year. Reason: In the interests of the amenities of nearby noise sensitive properties. |
9) A log of all works, ie soil stripping, construction and removal of noise bunds, soil storage mounds, etc that allow for an increase in daytime noise limits of up to 70dB(A) LAeq (free field) ( and in the case of Burnt Hill 51dB (A) LAeq (free field) shall be recorded in an environmental logbook to be kept at the Blashford Site office. All records shall be kept for a period of at least two years and shall show the dates and duration of these works and shall be available to the Mineral Planning Authority for inspection on request. Reason: In the interests of the amenities of nearby noise sensitive properties. |
10) Noise shall be monitored in accordance with the approved noise monitoring scheme (V2) (10 September 2008) - document ref: 07222/let/js/b with the exception of paragraph (3a) as the nominal daytime noise limit not to be exceeded shall be in accordance with those specified in the relevant conditions below. The scheme shall be extended to include Karma Cottage with regards to noise emitting from the Blashford Plant Site. Reason: In the interests of local amenities and the occupants of nearby residential properties. |
11) Before enabling/preliminary works on the sites commence, a specification for the noise levels from the reversing bleepers installed on vehicles on the various sites, which shall be white-noise type alarms, shall be submitted to the Mineral Planning Authority in writing for approval. Reason: In the interests of the amenities of the occupants of nearby residential properties. |
12) All vehicles, plant and machinery operated within the site shall be maintained in accordance with the manufacturers' specification at all times, and shall be fitted with and use effective silencers. Reason: In the interests of the amenities of the occupants of nearby residential properties. 13) Noise mitigation shall be carried out in accordance with revised AAD report `noise monitoring scheme'. except where otherwise stated by conditions within this certificate. Reason: In the interests of local amenities. Dust 14) Best Available Techniques (BAT) shall be used on the site at all times to reduce the impact of dust from all operations and activities, including plant, equipment, vehicles and machinery. Reason: In the interests of local amenities. 15) Before development commences, details of the existing ambient conditions relating to dust, at all dust sensitive premises, over a period of not less than six months, to take into account seasonal variations in the range of existing conditions (including existing mineral extraction operations at Nea Farm Quarry and operations at Blashford Plant Site), shall be submitted in writing to the Mineral Planning Authority for approval. Reason: In the interests of local amenities. 16) The site shall be operated in accordance with the approved SLR Dust Monitoring and Mitigation Scheme (V2) document ref: 07222/let007/js/b dated 10 September 2008. The Scheme shall operate throughout the duration of the development and restoration operations unless otherwise agreed by the Mineral Planning Authority. Reason: In the interests of local amenities. Light 17) No lighting shall be installed on the site until a lighting scheme has been submitted to and approved by the Mineral Planning Authority. The lighting scheme shall include both existing and proposed horizontal illuminance (lux) levels at ground level of the hereby approved site and also the nearest light sensitive premises. The scheme shall also include the existing and proposed vertical illuminance (lux) levels at ground floor height and first floor height at the nearest light sensitive premises. All lighting installed on the site shall be in accordance with Zone E1 of the Institute of Lighting Engineers document - Guidance Notes for the Reduction of Obtrusive Light dated 2005. Reason: In the interests of local amenities. Highways 18) No vehicular access is to take place within the Avon Valley Ramsar, SPA or River Avon SAC or, other than for conveyor maintenance vehicles. Reason: To ensure the protection of internationally designated sites. 19) Measures shall be taken to ensure that no mud is deposited on any public highway. If, in the rare event, this does happen, the mud must be thoroughly removed from the highway immediately following its deposition. Reason: In the interests of Highway Safety. 20) Temporary site access roads shall be maintained in a condition free from potholes while in use and shall be removed when no longer required or during the course of site restoration, whichever is the sooner. All sections of access road shall be ripped before being covered with overburden or soils and restored. Reason: To ensure that the site is satisfactorily restored and to minimise noise disturbance to neighbouring residents. 21) No mineral deposit which shall be extracted from the Plumley Wood or Nea Farm site shall be exported from the site other than by the approved conveyor system connecting to Burnt Hill. No mineral deposit that is washed or stored at Burnt Hill shall be exported other than by using the conveyor system to Blashford processing plant. Reason: To prevent transfer of material by road and in the interest of highway safety. Protection of Water Environment 22) All silts and fines that accumulate around various parts of the conveyor system linking Plumley Wood and Blashford Plant Site shall be contained, to the satisfaction of the Mineral Planning Authority. Reason: To protect against the risk of flooding and to ensure no adverse impact is caused to public rights of way or by way of silt deposition affecting integrity of River Avon SAC, Avon Valley Ramsar and SPA. 23) No excavation shall take place to levels below the final working depth indicated on the approved drawing including those approved under permission no. 06/88238. Reason: To protect the water environment, and to prevent changes to hydrological regime that may affect the integrity of internationally designated sites 24) No dewatering over and above that approved by this permission shall take place on the site without the prior approval of the Mineral Planning Authority in writing. Reason: In order to safeguard against water pollution, to ensure protection of internationally designated sites and ensure the site is capable of satisfactory restoration. 25) Any facilities for the storage of oils, fuels or chemicals shall be sited on impervious bases and surrounded by impervious bund walls. The bund capacity shall give 110% of the total volume for single and hydraulically linked tanks. If there is multiple tankage, the bund capacity shall be 110% of the largest tank or 25% of the total capacity of all tanks, whichever is the greatest. All filling points, vents, gauges and sight glasses and overflow pipes shall be located within the bund. There shall be no outlet connecting the bund to any drain, sewer or watercourse or discharging onto the ground. Associated pipework shall be located above ground where possible and protected from accidental damage. Reason: To prevent pollution of the water environment and to ensure protection of internationally designated sites. 26) No sewage or trade effluent (including vehicle wash or vehicle steam cleaning effluent) shall be discharged to any surface water drainage system. Reason: To prevent pollution of the water environment and to ensure the protection of internationally designated sites. Landscape 27) No work shall be carried out within the crown spread of trees to be retained, either underground or on the surface, including the storage of materials and excavated soil (including storage within the recycling plant at Lansford Plant Site) unless otherwise agreed beforehand by the Mineral Planning Authority in writing. All existing trees and shrubs retained and/or previously planted around the perimeter of the site for landscaping purposes shall be maintained in a healthy condition and protective fencing shall be erected around each tree or tree group to be retained at Nea Farm Quarry, at a distance of no less than five metres from the edge of the tree canopy, prior to any operations commencing within 15 metres of the crown spread of the tree or tree group to be retained. Such fencing shall be maintained during the course of the development. Any trees or shrubs required to be retained which die, are removed without permission, or become seriously damaged or diseased shall be replaced in the next planting season with others of similar size and species. Reason: To protect the health and stability of trees to be retained within and on the boundaries of the site. 28) All soil storage bunds intended to remain in situ for more than six months or over the winter period are to be grassed over and weed control and other necessary maintenance carried out to the satisfaction of the Mineral Planning Authority Scheme. The seed mixture and the application rates are to be agreed with the Mineral Planning Authority in writing no less than one month before it is expected to complete the formation of the soil storage bunds. For Nea Farm Quarry previously approved under planning permission no. 06/88238 these details shall be carried out in accordance with the Scheme approved on 11 February 2008. Reason: To preserve the existing soil resource and prevent weed spread. 29) A survey of the working face positions and working/restored landform at Plumley and Nea Farm Quarry (with reference to the existing survey control points at Nea Farm Quarry which shall be retained for the life of the permission) shall be undertaken annually by the applicant and copies submitted to the Mineral Planning Authority. Reason: To facilitate the monitoring of the development and ensure the land is capable of restoration in accordance with the approved details. 30) The Mineral Planning Authority shall be given 14 days prior notice of any tree felling operations related to this development. Reason: In the interests of local amenity. 31) Those parts of the site where stripping has yet to be undertaken shall be kept free of broadleaved weeds and all necessary steps shall be taken at any early stage of growth to prevent seeding. Reason: To facilitate the satisfactory restoration of the land. 32) The handling and movement of soils during both soil stripping and soil replacement operations shall only be carried out in suitable weather conditions and when soils are dry and friable, to prevent compaction, smearing and loss of structure. Reason: To minimise damage to existing and proposed soil reserves Nature Conservation 33) No trees or shrubs shall be felled during the period March to August inclusive unless otherwise agreed in writing by the Mineral Planning Authority. Reason: To ensure the protection of breeding birds. 34) By 30 November of each year following the implementation of this permission, a report shall be submitted to the Mineral Planning Authority identifying surveys on flora and fauna proposed for the following year on land to be developed of under this permission in the subsequent 5 years. Approval of the proposals by the Mineral; Planning Authority shall not be unreasonably withheld, and will be given in writing by the following 31 January. The report should include, inter alia, survey methods and timing (in accordance with best practice or variation thereof), and be subject to the requirements within: (i) After-care Management Strategy (AMS) revised August 2008 Andrews Consulting; (ii) First Tranche Biodiversity management Plan for Plumley and Burnt Hill- August 2008; (iii) Mitigation Strategy for Plumley, Burnt Hill and Blashford- July 2008; and (iv) Biodiversity Supervision Brief - August 2008. And for Nea Farm Quarry in accordance with the scheme approved under planning permission no. 06/88238. Reason: To inform appropriate mitigation for impacts on biodiversity. 35) By 30 November of each year following the implementation of this permission, a report outlining result of annual surveys carried out that year shall be submitted for approval to the Mineral Planning Authority Reason: To inform appropriate mitigation for impacts on biodiversity. 36) Fencing shall be erected and maintained around reptile translocation areas to the satisfaction of the Mineral Planning Authority Reason: To ensure protection of protected species. Archaeology 37) No works shall take place within the site ( including stripping of virgin soils, disturbance to the topsoil or tree roots (above and below ground, or extraction within any area of the site yet to be disturbed or worked relating to this permission) , shall take place until the applicant until the applicant has secured the implementation of a programme of archaeological work, in accordance with a written scheme of investigation, which has been submitted by the applicant and approved by the Planning Authority. which shall include: (i) Any previously identified archaeological features to be impacted on the site, (including the north-east corner of the site north of Shepherds Lane), either through aggregates extraction or through re-landscaping, will be excavated to a standard agreed through the submission and approval of a supplementary written scheme of investigation which shall be submitted to the Mineral Planning Authority for approval prior to any extraction subject of this permission commencing on the site. The scheme shall thereafter be implemented as approved. Reason: In the interests of archaeology. Restoration 38) The site shall be restored in accordance with initial restoration plan B58/298A and final restoration plan B58/299A and to the sequence and methodology as approved in Condition 3 of this permission and to individual restoration plans approved under site specific conditions of this permission. Reason: In the interests of the landscape character of the area and to ensure it. After-care 39) After-care of all the site subject of this development shall take place in accordance with the scheme approved for Nea Farm under planning permission no. 06/88238 and the following documents: (i) After-care Management Strategy (AMS) revised August 2008 Andrews Consulting; (ii) First Tranche Biodiversity management Plan for Plumley and Burnt Hill- August 2008; (iii) Mitigation Strategy for Plumley, Burnt Hill and Blashford - July 2008; and (iv) Biodiversity Supervision Brief - August 2008. Reason: To protect the nature conservation interest of the area. 40) After-care meetings between the developer and the Mineral Planning Authority shall be held annually, and no later than four weeks before each annual meeting a detailed 'scheme of works' for the after-care of the restored land for the next 12 months shall be submitted to the Mineral Planning Authority. No later than two weeks following the annual after-care meeting the annual 'scheme of works' shall be revised as necessary and submitted for the approval of the Mineral Planning Authority in writing. Reason: To bring the land to a standard suitable for agricultural use and nature conservation. Other 41) No skips or containers shall be stored on the site without the prior approval of the Mineral Planning Authority in writing. Reason: To help control the development taking place on the site and in the interests of visual amenities. Restriction of Permitted Development Rights 42) Notwithstanding the provisions of Parts 4, 8 and 25 of Schedule 2 of the Town and Country Planning (General Permitted Development) Order 1995 (or any order revoking and re-enacting that order): (i) fixed plant or machinery, buildings, structures and erections or private ways shall not be erected, extended, installed or replaced at the site without the prior agreement of the Waste Planning Authority in writing; and (ii) no telecommunications antenna shall be installed or erected without the prior agreement of the Waste Planning Authority in writing. Reason: To protect the amenities of the area Interim/revised Restoration Scheme 43) Should works on any part of the site subject of this permission. ie Blashford, Nea Farm Quarry, Burnt Hill Quarry or Plumley Quarry and the associated conveyors, for any reason, cease to operate for a period of more than six months, a revised restoration scheme shall be submitted for approval in writing to the Mineral Planning Authority within one month of identification by the Mineral Planning Authority of the of the said six month closure period. the revised scheme shall be implanted to a time table to be agreed in writing with the Mineral Planning Authority as part of the submission and associated approval process. Reason: In the interests of the landscape character, amenity and Nature Conservation Interests of the area. PLUMLEY CONDITIONS Pre- extraction 44) Prior to extraction of the silt ponds and the main extraction area at Plumley Wood as identified on the approved plans, the perimeter of the extraction shall be pegged out to the satisfaction of the Mineral Planning Authority. The main extraction shall be a minimum of 100 metres from the nearest residential property unless otherwise stated on the approved plans or agreed beforehand in writing with the Mineral Planning Authority. Reason: In the interests of those residents living within or on the boundary of the Plumley extraction area. 45) Before the commencement of the main extraction in Plumley Wood extending across Phases 1-9 on plan no. B58/286-299 all the preparatory works relating to the new conveyor shall be constructed in accordance with the approved plans in the certified locations and to the approved enabling working programme detailed in Land and Minerals Consulting Limited report revised (8 September 2008). These works shall be completed before extraction has completed at Nea Farm Quarry or by 31 December 2014 whichever is the sooner. This approved report includes details of the following: (i) the conveyor extension from Nea Farm, to Harbridge Drove and from Burnt Hill; (ii) the enclosed conveyor bridge; (iii) the conveyor section through the valley mire area of Burnt Hill; and (iv) The conveyor tunnel and the raising of footpath no.35. 46) Before main extraction commences in Plumley Wood extraction site as identified on the approved plans, silt ponds will have been prepared in the approved locations and the approved working scheme. Reason: To ensure the site is ready to take the silt produced by way of mineral washing at Burnt Hill. 47) Before main extraction commences at Plumley Wood, the washing plant associated facilities at Burnt Hill shall be constructed in accordance with approved plans, working scheme and specification. Reason: To ensure that the mineral extracted from Plumley is able to be washed prior to its transportation to Blashford by conveyor with the minimal of impacts on local amenities by way of noise and dust and lighting. 48) Prior to main extraction taking place survey points shall be established at locations to be agreed on site with the Mineral Planning Authority. Reason: To enable levels of extraction and restoration to be efficiently and accurately monitored. Hours of working 49) Except with the prior written agreement of the Mineral Planning Authority in writing no operations authorised or required by this permission relating to the area identified on the approved plans and Plumley Wood and Farm and footpath 35 , including the arrival and departure of construction vehicles for enabling and preparatory works shall be carried out and plant cannot be operated other than during the following hours: between 0700 and 1800 Monday to Friday; 0800 to 1300 on Saturday. there shall be no working on Sundays or recognised public holidays. Reason: In the interests of local amenities. Landscape 50) Within 12 months of the date of this certificate, advanced planting shall be undertaken in the location to the east of the Plumley extraction area and to the south-west as shown on Enabling Works Plan B58/287A and to the specification detailed in the approved documents. Reason: In the interest of local amenities and to enhance the nature conservation value of the area. Footpaths 51) No works shall take place on Footpath 35 associated with this permission until the Footpath has been temporary closed and appropriate signposts erected informing pedestrians and horse riders of this closure. The closure for the construction of the conveyor and raising of the footpath over the conveyor shall be completed within one week of the closure of the footpath for this purpose. Reason: To enable mineral from Plumley Wood to be extracted and transported to Blashford plant site in the most efficient timescale thus avoiding any unnecessary landscape and amenity impacts to nearby residents by way of excessive and unnecessary stockpiling and associated loading of materials by machine. Restoration 52) The site shall be restored to agriculture and nature conservation in a progressive manner as shown on approved plans `:Landscape' B58/286A-299A@A2 Lumley Wood: Phased Working and Restoration B58/305A Plumley Wood: Restoration Plan;· B58/306A Plumley Wood: Restoration Cross Sections.· B58/325 Plumley Wood: Restoration Cross Sections through Receptor Properties, and in accordance with method statement of and Pleydell Smithyman letter of 12 September 2008.and the approved agricultural statement and aftercare schemes.. Reason: To ensure this parts of the site being restored to agriculture reflect the quality of arable land restoration required. 53) That part of the site to be progressively worked and restored to nature conservation shall be undertaken in accordance with working and phasing plan nos. B58/286-299, accompanying report by land and Minerals Consulting Limited (revised 8 September 2008) and restoration plans B58/305A, B58/306A/B58 325. Reason: In the interests of nature conservation. Nature Conservation 54) A nature conservation area of approximately six hectares shall be provided and implemented at the same time the bund to the north of Blashford recycling area is constructed. The compensation land shall be created in the location as shown on plan no. B58/305A. Reason: In the interests of nature conservation. 55) Before the palmate newt pond adjacent to Wiggs Cottage is removed as part of the development, it shall be replaced in a location and to a design agreed by the Mineral Planning Authority in writing and the newts translocated in accordance with Best Practice. A methodology should be submitted and agreed in writing by the County Council prior to translocation. Reason: To ensure the protection of protected species, and in the interests of nature conservation. 56) Prior to undertaking preparatory washing plant and conveyor construction works at Burnt Hill in accordance with this permission, a reptile translocation programme shall take place in accordance with the approved methodology. The reptiles shall be translocated to the identified translocation site as shown on plan no. which in itself shall be prepared and ready to received reptiles as set out in the approved scheme. Reason: To ensure protection of protected species 57) The banks surrounding the plant site to the south and west and north shall be retained and remain undisturbed by the development. There shall be a minimum of 10 metre stand off between the sides of the quarry and mineral stockpiles adjacent to them, as shown on the approved plans and described in approved documents. Reason: In the interests of nature conservation and the landscape character of the area. Highways 58) Before the use hereby permitted is commenced a scheme detailing the removal of vegetation on Harbridge Drove to create an acceptable visibility splay at the junction of public footpath 30 and Harbridge Drove shall be submitted to and approved in writing by the Mineral Planning Authority. The agreed works shall be carried out before the use here permitted is commenced and the visibility splay thereafter retained. Reason: To ensure adequate access to Plumley and Burnt Hill. 59) No mineral deposit which shall be extracted from the Plumley Wood site shall be exported from the site other than by the approved conveyor system connecting to Burnt Hill. No mineral deposit that is washed or stored at Burnt Hill shall be exported other than by using the conveyor system to Blashford processing plant. Reason: To prevent transfer of material by road and in the interest of highway safety. Hydrology and Hydrogeology 60) Prior to any lagoons being filled with water from Hamer Brook and prior to any abstraction taking place a new `water off take sluice' shall be constructed to previously approved specification and location. Reason: To protect the water environment. 61) Main drainage for the site shall be undertaken progressively in accordance with Restoration Plan B58/305A and a scheme for details of agricultural underdrainage shall be submitted to the Mineral Planning authority for approval 12 months before final restoration soils are laid and the under drainage thereafter implanted in accordance with such approval. Reason: In the interest of the water environment. Agricultural Aftercare 62) A detailed aftercare scheme confirming the agricultural management strategy to be adopted should be prepared and submitted to the mineral planning authority. This should be detailed and accord with MPG 7, particularly Boxes 5 and 6 (as appropriate) and be submitted to the MPA at least 3 months before spreading of subsoil commences Reason: To ensure the land is restored to best and most versatile agricultural land and/or land of equivalent agricultural quality it was prior to extraction taking place. BURNT HILL Hours of Working 63) Except with the prior written agreement of the Mineral Planning Authority in writing no operations authorised or required by this permission relating to the area identified on the approved plans as Burnt HiIl , including the arrival and departure of construction vehicles for enabling and preparatory works and operation of the washing plant, shall be carried out and plant cannot be operated other than during the following hours: between 0700 and 1800 Monday to Friday; 0800 to 1300 on Saturday. there shall be no working on Sundays or recognised public holidays. Reason: In the interests of local amenities. 64) The only vehicle movement on the site shall relate to essential maintenance, arrival of staff and no more than six hours a week stockpile maintenance by way of a 360 excavator. The excavator shall work no more than 1.5 hours per day Monday to Friday. No working relating to the 360 excavator shall take place on Saturdays, Sundays or recognised public holidays. Reason: To minimise noise impacts to nearby residential properties. Nature Conservation 65) The stockpile of mineral to the south of the acoustic washing plant bund and to the north of Nea Cottage as identified on the approved plan shall be transported by conveyor to Blashford within a period of two years from date of its deposition in this location after which time the site shall start to be restored to heathland over the following six months and thereafter managed for nature conservation in accordance with the approved After-care Management Strategy (AMS) revised August 2008 Andrews Consulting and First Tranche Biodiversity Management Plan for Plumley and Burnt Hill - August 2008; and the approved restoration plan. The mineral should be stockpiled temporarily in these locations no higher than shown on the approved cross sections plans. Reason: In the interests of the residential occupants of Nea Farm Cottage 1 and 2 and the nature conservation enhancement of the area. 66) The stockpile of mineral to the north-west of the mineral washing plant and to the south of Harefield Lodge as identified on the approved plans shall be transported by conveyor to Blashford within a period of six years from date of its deposition in this location, after which time the site shall be immortally restored to heathland and nature conservation in accordance with the approved aftercare and management strategy. Reason: In the interests of the nature conservation enhancement of the area. 67) Prior to undertaking any preparatory or enabling works at Burnt Hill in accordance with this permission, a reptile translocation programme shall take place in accordance with the approved methodology. The reptiles shall be translocated to the approved site at the south-west corner of Plumley Wood. which in itself shall be prepared and ready to received reptiles as approved by way of this permission. Reason: To ensure protection of protected species. 68) The perimeter vegetated banks surrounding the Burnt Hill plant site to the north, west and south be retained and remain undisturbed by the development. There shall be a minimum of 10 metre stand off between the sides of the quarry /these perimeter banks and mineral stockpiles adjacent to them, as shown on the approved plans and associated documentation. Reason: In the interests of nature conservation and the landscape character of the area. 69) Prior to undertaking preparatory washing plant and conveyor construction works at Burnt Hill in accordance with this permission, a reptile translocation programme shall take place in accordance with the approved methodology.. The reptiles shall be translocated to the identified translocation site as shown on plan no. which in itself shall be prepared and ready to received reptiles as set out in the approved scheme. Reason: To ensure protection of protected species. 70) The banks surrounding the plant site to the south and west and north shall be retained and remain undisturbed by the development. There shall be a minimum of 10 metre stand off between the sides of the quarry and mineral stockpiles adjacent to them, as shown on the approved plans and described in approved documents. Reason: In the interests of nature conservation and the landscape character of the area. Landscape 71) Mineral stockpiles to the south of the washing plant as shown on cross section plan no. B58301A shall be no more than 48.4m AOD metres which is less high than the ridge of the bund (48.7m AOD) that forms the southern boundary and separates Nea Cottage east from the site. At all times the mineral stockpile south of the washing plant shall be lower in height than the ridge of the southern boundary land. The deep sand stockpiles to the north west of the washing plant shall be constructed to the levels shown on cross section plan B58/301A. Reason: In the interests of local amenities and the landscape character of the area. Noise 72) In accordance with paragraph 6 on page 8 of the noise report dated 12 June 2008 ref: 07222/let006/js (from AAD), except with the written permission from the Mineral Planning Authority, only one wheeled loader, (excluding essential maintenance and arrival/departure of staff), shall operate at the site during normal operations and this shall only operate to a maximum of six hours spread over two days between Monday to Friday. The wheeled loader shall not operate on Saturday, Sunday, or recognised public holidays. Reason: In the interests of local amenities. 73) Prior to the commissioning of the approved washing plant an acoustic mineral screening bund shall be constructed from mineral extracted from the silt pond area of Plumley Wood to the specification and location detailed in the approved plans. Reason: In the interests of local amenities. 74) A record shall be kept in the Environment logbook at the Blashford Plant Site Office of the date and duration of when the wheeled loader is operating. The records shall be kept for a minimum period of two years and shall be made available for inspection by the Mineral Planning Authority on request. Reason: In the interests of local amenities. 75) Before use commences, the Burnt Hill washing plant shall be built and acoustically insulated against the transmission of internally generated noise in accordance with the scheme as detailed in paragraph (1) (under heading Burnt Hill plant site) on page 1 of the noise report dated 12 June 2008 ref: 07222/let006/js. Reason: In the interests of local amenities. 76) Noise from the Burnt Hill washing plant and conveyors, combined with the wheeled loader, shall not exceed the levels at the boundary of the noise sensitive premises as set out in the BS5228 table at paragraph 5 on page 7 of noise report dated 12 June 2008 ref: 07222/let006/js. Reason: In the interests of local amenities. 77) Noise emitted from temporary works associated with site preparation, including the construction of the six metre high long term sand and gravel storage stock bund shall not exceed 51dB LAeq 1 hour (free field) in accordance with BS5228 at the boundary at Nea Cottage East and Nea Cottage West. Reason: In the interests of local amenities. 78) Noise from the Burnt Hill washing plant and conveyors excluding the operation of the wheeled loader, shall not exceed the levels at the specified noise sensitive premises set out in the BS5228 table at paragraph 6 on page 8 of the noise report dated 12 June 2008 ref: 07222/let006/js. Reason: In the interests of local amenities. 79) The washing plant shall be kept in good repair and maintained to ensure that it continues to operate in accordance with the above noise scheme. Reason: In the interests of the occupants of nearby residential properties. NEA FARM-BLUE HAZE-FOREST HAUL ROUTE Hours of Working 80) Except with the prior written agreement of the Mineral Planning Authority in writing no operations authorised or required by this permission relating to the area identified on the approved plans as Nea Farm, and under planning permission 06/88238 as forest haul route and Blue Haze, including the arrival and departure of construction vehicles for enabling and preparatory works and operation of the washing plant, shall be carried out and plant cannot be operated other than during the following hours: between 0700 and 1800 Monday to Friday; 0800 to 1300 on Saturday. there shall be no working on Sundays or recognised public holidays. Reason: In the interests of local amenities. Time 81) The winning and working of the minerals at Nea Farm Quarry hereby approved together with transportation of the minerals by field conveyor from Nea Farm Quarry to Blashford Plant Site, shall cease by 31 December 2014 and the all associated plant, conveyor (and associated equipment and machinery), with the exception of that part of the conveyor linking Plumley Wood with Blashford and the plant site at Blashford, shall be removed within six months of the cessation of extraction; and the land at Nea Farm Quarry restored to a combination of agriculture and parkland (including lakes and tree planting) in accordance with [planning permission no] (drawing numbers as will revoke Nea Farm) by 31 December 2015 and the Forest Haul Route from Blue Haze to Nea Farm shall cease to be used for the purposes of serving Nea Farm Quarry and shall be restored to a combination of nature conservation areas and forestry rides with planning permission no.06/88328 Reason: To comply with schedule five of the Town and Country Planning Act 1990, and to minimise the duration of disturbance from the operations hereby approved. Working programme 82) The development at Nea Farm Quarry shall be undertaken in accordance with the details of the approved `Sequenced Working and Restoration Description' prepared by L&M Consulting dated 19 May 2006 under permission no. 06/88238. Reason: To enable the Mineral Planning Authority to adequately control the development and to minimise its impact on the amenities of the local area. 83) Overburden/restoration materials will be stored at Blue Haze Quarry in the location shown on plans approved under permission 06/88238 awaiting transportation to Nea Farm via the haul route to be approved under this permission.. Reason: To demonstrate that the storage of materials at Blue Haze Quarry under this permission for restoration purposes at Nea Farm will not interfere with the phased infilling of the Blue Haze void with waste as detailed in the scheme of working (August 2005) for Chatsworth landfill permission no. 0006045M. 84) The transportation of overburden/restoration materials from Blue Haze Quarry to Nea Farm Quarry shall be undertaken via a forest haul route the details and alignment of which are to be secured through a scheme to be submitted to the Mineral Planning Authority within 3 months of the date of this permission. Transportation of the mineral by the said haul route shall cease by 30 November 2014 and the Forest Haul Route restored in accordance with the scheme approved under permission no. 06/88238 unless otherwise agreed in writing beforehand by the Mineral Planning Authority. Reason: To control the restoration of Nea Farm Quarry, ensure the continuation of landfill at Chatsworth and ensure that the land subject of the forest haul route is restored to a satisfactory condition. Highways 85) The only permitted access for the transportation of overburden/restoration materials across Harbridge Drove from Blue Haze to Nea Farm Quarry shall be that location shown on approved the Hurlstone Partnership Drawing Numbers THP1, dated May 2006. Reason: In the interests of highway safety. 86) Prior to the commencement of the transportation of overburden/restoration materials from Blue Haze Quarry to Nea Farm Quarry via the approved Forest Haul Route, the Forest Haul Route crossing of Harbridge Drove, as shown on the Hurlstone Partnership Drawing Number THP1 and Figure 2 dated May 2006 and submitted as part of application number 06/88238 shall be constructed and maintained for the duration of works by the applicant to the satisfaction of the Highway Authority. Reason: In the interests of highway safety. 87) On completion of the transportation of overburden/restoration materials across Harbridge Drove from Blue Haze Quarry to Nea Farm Quarry, the Forest Haul Route crossing of Harbridge Drove shall be dismantled and any remedial works considered necessary by the Highway Authority to ensure that Harbridge Drove is returned to its former condition shall be undertaken within a timeframe and by way of a methodology to be agreed beforehand by the Highway Authority in writing. Also, the visibility splays adjacent to Harbridge Drove related to the road crossing, shall be prepared for replanting and shall be then planted with broad leaved native trees in accordance with a scheme to be agreed beforehand with the Mineral Planning Authority, as required by this permission. The replanting shall take place within the first planting season following final removal of the Forest Haul Route crossing. Reason: In the interests of highway safety and the amenities of the area. 88) The traffic lights approved under permission no. 06/88238 and required for the Forest Haul Route crossing shall be removed within 48 hours after each 'campaign' haulage of materials from Blue Haze Quarry to Nea Farm Quarry has been completed and shall be replaced shortly before the next 'campaign' commences. Reason: In the interests of highway safety. Landscape 89) Soil storage, weed control and maintenance of bunds for Nea Farm shall be carried out in accordance with Scheme approved by the Mineral Planning Authority on 11 February 2008 under planning permission no.06.88238. The seed mixture and the application rates are to be agreed with the Mineral Planning Authority in writing no less than one month before it is expected to complete the formation of the soil storage bunds. Reason: To preserve the existing soil resource and prevent weed spread. 90) At Nea Farm Quarry, heights of mineral, overburden and restoration material stockpiles (with the exception of those soil storage mound heights identified in Table (a) Page 10 of the approved `L and M' Sequenced Working and Restoration Scheme dated 19 May 2006) shall not exceed four metres above original ground/unexcavated ground levels, and any material stockpiles below original ground levels shall not exceed six metres in height (and at no time exceed four metres above unexcavated ground level), unless otherwise agreed beforehand in writing by the Mineral Planning Authority. Reason: In the interests of local amenities and the landscape character of the area and site. Restoration 91) The site of Nea Farm Quarry shall be restored progressively to an agricultural parkland landscape, including lakes and tree planting in accordance with the principles outlined in the following approved documents and drawings submitted as part of application number 06/88238: (i) the land use and topographical proposals in approved Drawing Numbers: B58/237A entitled `Revised Restoration Plan' dated May 2006; B58/238B entitled `Restoration Sections 1-4' dated May 2006; and B58/239A entitled `Restoration Sections (Detailed) A-D' dated May 2006 and B58/259A entitled `Revised Restoration Contours'; (ii) the tree, shrub and grass planting, maintenance and protection details in the approved `After-care Management Strategy' prepared by Copthill Environmental Land Management dated May 2006; and (iii) the timing and sequence of restoration; the thickness and quality of any subsoil and topsoil to be used in restoration; and the method of soil handling and spreading including the machinery to be used as detailed in the approved `Sequenced Working and Restoration Description` prepared by L&M Consulting dated 19 May 2006. Reason: In the interests of local amenities and the landscape character of the area. 92) Details expanding on these Nea Farm restoration principles shall be submitted to the Mineral Planning Authority for approval within six months of the date of this permission and shall include: (i) details relating to the lake margins and the conduit/valley feature linking two of the lakes; (ii) cross sections at a detailed scale demonstrating the type of planting to be undertaken around the lake margins and features within the lake boundaries; (iii) details of fencing, gates, path surfacing, drive surfacing and any foot or vehicle bridges to be constructed; and (iv) proposals for opening up the views of Shepherds Lodge. Reason: To ensure that the site is satisfactorily restored. 93) All topsoil and overburden stripped from the areas to be excavated at Nea Farm Quarry shall be removed and stored separately before operations commence for use in restoration. Following tipping and during restoration, overburden shall be replaced and graded in accordance with the final levels hereby approved, any necessary measures shall be taken to alleviate any soil compaction. The overburden shall in turn be covered with the topsoil to even depths, as specified in the approved `Sequence Working and Restoration Description' prepared by L&M Consulting dated 19 May 2006. Reason: To ensure the satisfactory restoration of the land to agriculture. Nature Conservation 94) Before each `campaign' of haulage of materials between Blue Haze Quarry and Nea Farm Quarry takes place, reptile fencing shall be placed alongside the part of the Forest Haul Route as identified in outline on approved plan no. B58/241 and in detail under Condition (46), where these species are known to exist. The fencing shall be part taken down after each haulage 'campaign' to allow some movement of reptiles across the Forest Haulage Route and this shall be detailed in the scheme to be submitted to the Mineral Planning Authority under Condition (46). Reason: To ensure the protection of smooth snakes and reptiles. 95) Prior to the transportation of approved overburden/restoration materials from Blue Haze Quarry to Nea Farm Quarry via the Forest Haul Route shown on approved Plan No. B58/241, a detailed plan of the route, any necessary vehicle passing bays, nature conservation buffer zones (10 metre minimum either side of Forest Haul Route), reptile fencing and an accompanying written programme of implementation, management, restoration and after-care shall be submitted to the Mineral Planning Authority for approval in writing and the route shall be implemented in accordance with this approval. The first 50 metres west from Harbridge Drove and north from Blue Haze Quarry, shall not have a buffer either side and shall be a single width haul route unless otherwise agreed by the Mineral Planning Authority in writing. The programme should include a timetable of when prior tree felling and implementation as well as restoration to heath land would take place. This timetable should aim to restore the Forest Haul Route within 12 months of the cessation of use of the Forest Haul Route but no later than 31 December 2015 unless otherwise agreed in writing by the Mineral Planning Authority. The Mineral Planning Authority shall approve on site the line of the Forest Haulage Route, buffer zone and fencing prior to any tree felling taking place. Reason: To ensure the protection of birds and reptiles habiting the Ringwood Site of Importance for Nature Conservation including those species protected under the Wildlife and Countryside Act. BLASHFORD Hours of Working 96) Except with the prior written agreement of the Mineral Planning Authority in writing no operations authorised or required by this permission relating to the area identified on the approved plans as Blashford and Lodge Field, including the arrival and departure of construction vehicles for enabling and preparatory works and operation of the mineral plant, shall be carried out and plant cannot be operated other than during the following hours: between 0700 and 1800 Monday to Friday; 0800 to 1300 on Saturday with the exception of the bagging plant and the concrete plant which can be carried out between the hours of 06.15 and 18.30 Monday to Friday and 06.15 to 13.30 hours on Saturdays. There shall be no working on Sundays or recognised public holidays. Reason: In the interests of local amenities. Protection of the Water Environment 97) Other than water that may be properly discharged under licence from the Environment Agency, all surface water collecting from the recycling site and from within the aggregate bagging plant site shall be contained within Blashford Plant Site and prevented from entering adjacent land, in particular the adjacent areas of nature conservation interest, the River Avon and adjacent water bodies. Reason: To protect the nature conservation interests of the River Avon and its associated valley. Stockpiles 98) All material stockpiles (i.e. stockpiles of all raw/processed inert construction and inert demolition waste and mineral aggregate) at Blashford Plant Site shall not exceed seven metres in height above existing ground level. Reason: in the interest of visual and local amenities. Restoration 99) Blashford Plant Site and the adjoining area to the south forming part of the application site known as 'Goblins Lake' shall be restored to agriculture, nature conservation and amenity including the provision of footpaths in accordance with a scheme to be submitted to the Mineral Planning Authority within six months of the date of this certificate, pending outcome of Plumley. The scheme shall include retention of the bund immediately to the north of the Blashford Plant Site (created by the importation of soils from Ibsley Quarry) until 31 December 2015 or when mineral processing operations at Blashford terminate whichever is the sooner, after which time the subject bund shall be removed and used in the restoration of Blashford Plant Site. Reason: To ensure that the site is satisfactory restored in a way that enhances the landscape, conservation and amenities of the area. Noise and Dust 100) Noise emitted from the Blashford Plant site between 06:15 and 07:00 hours shall not exceed a Rating Level (in accordance with BS4142:1997) of 38dB LAeq 5 min (free field) at the boundary at Ellingham Lodge. [as per the BS5228 assessment at page 4 of the noise report ref: 07222/let007/js/b dated 10 September 2008]. Reason: In the interests of amenities of local residents. |
101) No more than 50,000 tonnes of inert construction and demolition arisings may be imported to the recycling site at Blashford Plant Site in any one year. Reason: In the interests of visual amenities and the satisfactory operation of the site. 102) No more than 40,000 tonnes of either arisings or secondary aggregates may be stockpiled on the recycling site in the location denoted on Plan No. B58/264 at any one time. Reason: To ensure the satisfaction operation of the site within its boundaries and in the interests of local amenities. 103) Details of the design and the specification of any additional cladding to be attached to the mineral processing, sand screening or recycling plant shall be submitted to the Mineral Planning Authority for approval in writing prior to the said cladding being erected in accordance with any such approval. Reason: In the interests of amenities of local residents 104) The operators of the recycling facility shall maintain monthly records of their monthly importation of construction and demolition arisings and shall be made available to the Mineral Planning Authority on request. Reason: To help and enable the Mineral Planning Authority to monitor the site. Highways 105) Prior to the development hereby permitted commencing full details of the widening works to the Blashford Plant Site access road linking the site to the A338 Salisbury Road shall be submitted to and approved in writing by the Minerals Planning Authority. The approved details shall be constructed to he written satisfaction of the Minerals Planning Authority prior to the use hereby approved being implemented. Reason: To ensure adequate access to and from the site. 106) No later than six months prior to the cessation of activities at the Blashford Plant Site a scheme setting out works to modify the existing site access and to reduce its size and function in line with the cessation of activities shall be submitted to and approved in writing by the Mineral Planning Authority. The agreed details shall be constructed to the written satisfaction of the Mineral Planning Authority before the use hereby permitted ceases. Reason: In the interests of highway safety. |
