1) The following decision was made: |
1.1. That authority be given to the Director of Adult Services to enter into an agreement between Hampshire County Council and Hampshire Primary Care Trust for the operation of a joint system for the Deprivation of Liberty Safeguards (DOLS). |
2) Reasons for the decision |
2.1. Department of Health advice that such an agreement is necessary for joint DOLS systems between local authorities and PCTs |
2.2. To provide a mechanism for the operation of a joint DOLS system including necessary financial transactions between Hampshire County Council and Hampshire PCT and employee insurance/indemnity issues |
3) Other options considered and rejected: |
3.1. Option 1: Include agreement as a schedule to the Section 256 agreement with Hampshire PCT |
a) Risk Assessment: No longer appropriate due to Department of Health advice |
3.2. Option 2: Include agreement as a schedule to the Section 75 agreement with Hampshire PCT |
a) Risk Assessment: Not possible within the time available |
3.3. Option 4: Cancel the arrangements for the joint DOLS system and operate independently from Hampshire PCT |
a) Risk Assessment: Could leave Hampshire County Council unable to fulfil its statutory duties under DOLS |
