EXECUTIVE SUMMARY
1) Summary of Decision Area:
1.1. The report summarises the procurement actions taken during 2008/9, analyses the outcomes and seeks approval to a number of further procurement initiatives relating to the delivery of building construction work and the maintenance of the Corporate Estate on behalf of the County Council for 2009/10 and beyond.
2) Issues Covered in Report:

2.2. Review of procurement activities during 2008/9.

3) Recommendations:
That the Panel advises the Executive Member for Policy and Resources:
3.1. That, subject to confirmation of grant funding from the Learning and Skills Council, selection and appointment of a contractor under the IESE Tier 1 framework to provide pre-construction and design services up to a maximum value of £350,000 in connection with the proposed extension of the sixth form at Ringwood (Foundation) School, be approved.
3.2. That the success of the Shared Services Agreement with Reading Borough Council be welcomed and it be used as an exemplar model for any future Shared Services Agreement with other authorities.
MAIN REPORT
1) Purpose of the Report:
1.1. The purpose of this report is to summarise the procurement actions taken during 2008/9, analyse the outcomes and seek approval to a number of further procurement initiatives relating to the County Council's building construction work for 2009/10 and beyond. The report also updates the Panel on the highly successful Shared Services arrangements with Reading Borough Council.
2) Contextual Information:
2.1. The Executive Member for Policy and Resources approved on 9 April 2008 the annual review of construction related procurement for 2007/8 and a series of new initiatives to be implemented during 2008/9 and beyond. A number of further proposals were approved at the meetings on 23 July 2008, 16 October 2008 and 29 January 2009.
2.2. The completion of projects and programmes of work through framework and term contract arrangements ensures that schemes and programmes of work are delivered in a cost-effective way, involving closer working and collaboration with the construction industry which ensures continuous improvement in the County Council's services and enhances the quality of place in Hampshire.
3) Overview
3.1. During the last 12 months the main focus of procurement activity within Property Services has been to establish a number of consultant and contractor frameworks through the OJEU tender process in line with the procurement model set out in the report to the Panel on 2 April 2008.
3.2. The department has also continued to procure capital projects and programmes of work through the frameworks established by the County Council on behalf of Improvement and Efficiency South East (IESE).
3.3. The department continues to operate robust performance management arrangements and implement procurement initiatives in line with the corporate procurement strategy, such as electronic tendering and gateway reviews.
3.4. In addition the department has continued to lead the Construction and Asset Management Partnership for Improvement and Efficiency South East. Further information on the work undertaken during 2008/9 and the priorities for the coming financial year are provided later in this report.
4) Development of Procurement Model
4.1. The Property Services Procurement Model, set out in the report to the Panel on 2 April 2008, is based on the procurement of projects and programmes of work through a range of general and specialist framework and term contract arrangements. These arrangements involve closer working and collaboration with the construction industry, facilitating a more robust assessment of project risks and improved pre-construction planning. Previous analysis has shown that this approach supports continuous improvement through improved certainty of outcomes, ensuring that projects are delivered in a cost-effective way.
4.2. As previously reported to the Panel, the County Council has established three contractor frameworks on behalf of IESE; the Tier 1 framework for procurement of major building projects across the south east of England and the Tier 2 and Tier 3 frameworks for procurement of medium and small building projects within Hampshire. All of these frameworks are now being used for delivery of the County Council's building projects as detailed in section 5 of this report.
4.3. During 2008/9, OJEU tenders have been completed for the following additional arrangements identified in the procurement model:
a) A combined building and engineering maintenance contract for the Castle Complex headquarters buildings which brings together previously separate arrangements into a combined `hard' facilities management contract, in line with the County Council's modernised and centralised FM model.
b) A framework for the delivery of hard landscaping works including works funded through the School Access Initiative (SAI) and more specialist works such as Multi Use Games Areas (MUGAs) and Synthetic Turf Pitches (STPs). Use of the framework will allow projects to be packaged into programmes of work to seek benefits from continuity of the project team and transfer of learning from one project to the next.
c) Consultancy frameworks for structural inspections, structural engineering design, mechanical and electrical engineering design, quantity surveying, landscape architecture and ecology and building control services.
4.4. Further details on the scope of these frameworks and the successful tenderers are provided at Appendix C.
4.5. Tenders for the following further arrangements are currently in progress and are due to be completed within the next financial year:
a) Area based frameworks for provision of reactive building maintenance across the county, which will align with the current area based engineering maintenance term contracts and support the move towards a more strategic approach to facilities management.
b) A framework for procurement of external repair and decoration work which builds on previous experience of procuring this work with a number of preferred contractors which provided benefits in terms of improved quality of work and better programme management.
c) Renewal of the framework for hire and purchase of temporary buildings.
d) New consultant frameworks for transport planning, planning and urban design, CDM Co-ordinator and building surveying services.
4.6. In addition the following arrangements are currently being scoped with a view to commencing procurement shortly:
a) Framework for electrical testing and inspection
b) Contract for provision of suitability and sufficiency surveys, CAD plans together with a database system and web interface for the storage and access of this data.
4.7. Progress and the outcome of these tenders will be reported to future Panel meetings.
4.8. By introducing framework arrangements for the procurement of lower value projects and specialist works, Property Services is seeking to achieve improved outcomes such as certainty of time and cost through involving contractors in pre-construction planning. These arrangements also support the aggregation of similar projects into programmes of work, providing efficiencies through a common approach to design and shared supply chains. Continuity of the project team from one scheme to the next also allows transfer of lessons learned to drive continuous improvement.
4.9. As the Panel will be aware, the downturn in the economy is having a significant impact on the construction industry which has seen an increased interest in the County Council's tendering opportunities. The mixed economy approach to procurement, together with the development of framework arrangements for small to medium sized projects, ensures continuing opportunities suited to local contractors and suppliers. In addition, the use of local suppliers is encouraged through the contractor forums for the IESE frameworks.
5) Construction Work 2008/9
5.1. A total of approximately £88 million of construction work has been contracted by the department during 2008/9 on behalf of the County Council. This is similar to the value of work procured during 2007/8 excluding the refurbishment of Ashburton Court but is lower than previous years in line with the County Council's reduced capital programme.
5.2. Projects have been delivered through a range of procurement routes, including:
a) £15 million of work procured through the Hampshire Framework for Major Schemes, including 11 modular building projects for the Phase 2 Children's Centre programme.
b) 2 schemes with a combined value of £5.9 million procured through the IESE Tier 1 framework, of which £6 million is grant funding by the Learning and Skills Council (LSC).
c) 2 schemes with a combined value of £1.7 million through the IESE Tier 2 framework.
d) In excess of 50 schemes or programmes of work with a combined value of approximately £7 million through the IESE Tier 3 framework.
5.3. Contractors have been identified for further £23 million of projects currently in the pre-construction stage of procurement through the IESE frameworks. A schedule of framework schemes is provided at Appendix D
5.4. The IESE Tier 1 and Tier 2 framework arrangements are based on the selection and appointment of the main contractor early in the design phase of the project to work as part of the project team. The contractor provides a range of pre-construction services with a view to reducing the risks during the construction stage thereby increasing the certainty of outcomes in terms of cost, time, quality and health and safety. The pre-construction services include buildability advice, cost planning, subcontractor procurement and construction planning and programming for which the contractor is paid a pre-construction fee.
5.5. To ensure that the contractor's input can be used to advantage on the project, the appointment is normally made prior to approval of the project appraisal. Award of the construction contract is not completed until after project appraisal, once the sub-contractor procurement process has been completed.
5.6. Property Services has supported Ringwood (Foundation) School in an application for funding to the Learning and Skills Council for a £4.6 million grant to facilitate the extension and refurbishment of their sixth form buildings. If this bid is successful, it is proposed to select and appoint a contractor through the IESE Tier 1 framework to progress the project on a contractor design basis.
5.7. To meet the anticipated construction programme, approval is sought for the selection and appointment of a contractor to provide pre-construction and design services prior to approval of the project appraisal and conclusion of the construction contract later in the year. The estimated maximum value of the contractor's fee for construction and design services is £350,000.
6) Future initiatives
6.1. Over the coming year, the department will contribute to the development of procurement strategies for the County Council's major building related initiatives to ensure the appropriate use of frameworks and other procurement arrangements to deliver high quality projects in a cost-effective way. These will include building projects and works linked to the following key initiatives:
a) Sure Start, Early Years and Childcare Grant funded projects in Private and Voluntary and Independent (PVI) settings.
b) Children's Centres Phase 3 (refer to Major Projects update for further information)
c) Primary Capital Programme - 2010/11 and beyond
d) Building Schools for the Future (refer to Major Projects update for further information)
e) 14-19 capital projects - subject to confirmation of DCSF grants
f) Hampshire Workstyle
g) Other Capital Programme works for Adult Services and Recreation and Heritage
7) Electronic Tendering
7.1. During 2008/9, Property Services has continued to procure projects through the County Council's e-tendering system called In-Tend. This has included traditional competitive tenders, mini-competitions for the selection of contractors under the IESE framework arrangements and full OJEU tenders. The requirements under the County Council's Standing Orders are adhered to throughout the e.tendering process.
7.2. Electronic tendering has generally worked well, requiring less hard copy documentation and therefore reducing the amount of administrative time required to support the tendering process. Over the next few months, it is anticipated that e-tendering will become the preferred approach for the majority of tenders managed through the department and the County Council as a whole.
8) Performance Management
8.1. All of the work procured through the department is evaluated through agreed performance management arrangements. These include measuring the performance of projects, in-house project teams, consultants and contractors through a range of qualitative and quantitative key performance indicators.
8.2. A detailed analysis of performance will be submitted to the Panel in June 2009, once all the data for projects completed during the financial year 2009/10 has been collated and analysed.
8.3. To support ongoing improvement in the delivery of building construction projects, the department is implementing a gateway review process. Gateway reviews are held at key stages of the project to assess project risks and ensure that it is fit to proceed to the next stage. Gateway reviews are already undertaken on projects procured through the IESE frameworks and these arrangements are now being extended to all projects with a value of £1 million or higher.
9) Improvement and Efficiency South East
9.1. The County Council has continued to lead the Construction and Asset Management Partnership of IESE. The report to the 14 July 2008 Panel noted the 6 "project" areas, which were being developed under the programme. These are:
a) Regional Building Construction Framework (Tier 1 Framework)
b) Cluster development - sub regional Construction Frameworks
c) Regional professional services consultancy framework
d) Shared Services and Asset Management
e) Highways and Transportation
f) Supply Chain Development
9.2. A "Theme Steering Group" has been set up to keep an overview on governance type issues. The group is chaired by either Cllr Davidovitz, or the Chief Executive as the lead Chief Executive for the theme. The meeting is also attended by chief officers and other senior representatives from around the region, and the Chief Executive of the Office of Government Commerce (OGC).
9.3. The South East Regional Building Construction framework is now delivering impressive efficiencies and performance improvement. There are now 80 projects in process, 10 complete, and the County Council is working with up to 40 authorities. A more detailed report will be included with the June Panel meeting papers, but the following key efficiency improvements have already been achieved:
a) Realisation of around £6.7m in procurement efficiency savings since the framework started in July 2006 which is shared amongst participating authorities.
b) Current contractors performance scores also show a 28% improvement over similar conventional competitive tender scores.
9.4. Colleagues in the Environment department have been working with the Procurement Team to develop further "projects" under the Highways and Transportation banner. A separate report on this matter is found elsewhere on this agenda. A number of key projects have been identified for scoping and delivery over the next two years. Further details of the arrangements which will be developed will be reported to future meetings of this Panel. Subject to final consultation work it seems likely that procurement arrangements which will be developed are likely to comprise:
a) Regional Capital Works (Construction) Framework on a similar basis to the Regional Building Construction Framework.
b) Regional Professional Services Framework
9.5. In addition, the County Council has been supporting the South West Improvement and Efficiency Partnership as they develop a regional building construction framework for the South West Region, which is now at tender evaluation stage.
9.6. The County Council was also commissioned by the IESE Corporate Transformation Theme to carry out a health check of the programme board for schools delivery for Milton Keynes Council. This was completed recently and the published report was well received by the authority
10) Reading Borough Council - Shared Services Agreement
10.1. On 19 October 2007, the Executive Member for Policy and Resources gave approval for the County Council to enter into a Shared Services agreement, through IESE with Reading Borough Council. The agreement was formally signed off in June 2008. |
10.2. For the past two years Reading Borough Council has commissioned the County Council's design services for major programmes of work, all of which are being delivered in accordance with best practice principles of collaborative working using framework contractors. Through 2008/09 £20m of construction projects have been procured on behalf of Reading Borough Council this translates to £1.5m of fee income into Property Services which has helped to maintain staff resource levels in the context of the County Council's reducing programme . Exemplar projects include extension and remodelling schemes at Alfred Sutton Primary School and Church End Primary School. |
10.3. The working arrangements are now well-established and respected by both authorities and continue to develop in a positive direction. This collaborative working model demonstrates clear leadership from Hampshire County Council and how local authorities can work together to achieve successful outcomes. It is anticipated that this agreement will continue for a number of years and is highly likely to become the model for future Shared Services. |
11) Outline of Options:
11.1. The County Council's procurement actions are governed by the Public Procurement Regulations 2006 and the Council's Contract Standing Orders. In addition, the Council's procurement model and strategy for building construction work, approved by the Executive Member for Policy and Resources at his meeting of 9 April 2008, provides the framework within which procurement decisions relating to building construction work are made.

13) Conclusions:
13.1 The procurement decisions set out in this report comply with the Public Procurement Regulations 2006 and the Council's Contract Standing Orders. The proposals are also in line with the procurement model and strategy for building construction work approved by the Executive Member for Policy and Resources at his meeting of 9 April 2008 and the business plan for the Construction and Asset Management workstream of IESE.
