1. Executive Summary
1.1. The purpose of this paper is to seek approval to a list of transport improvement schemes to support the seeking of Transport Contributions in the Winchester District in accordance with the adopted County Council's Transport Contributions Policy, and for the rolling out of the methodology for scheme identification across the County.
1.2. This paper sets out:
(i) Background to Transport Contributions Policy;
(ii) Recent Appeal Decisions;
(iii) Methodology for Scheme identification and approval;
(iv) Winchester City Council Proposals; and
(v) Recommendations.
2. Contextual Information
Background to Transport Contributions Policy
2.1. In September 2007 the Cabinet adopted a policy for seeking Transport Contributions from new development sites in order to fund improvement schemes to mitigate the impact of development, and particularly to encourage access to and from development sites by means of transport alternatives to the private car.
2.2. The Transport Contributions Policy (TCP) sets out a standard methodology for calculating the level of financial contribution to be sought and applies to all new development within the County where an increase in daily multi-modal trips is expected as part of the proposal. A cost per trip is applied to all net additional multi-modal trips per day and the calculated financial contribution is taken towards implementing the Area Transport Strategies, set out in the Local Transport Plan (LTP). The TCP indicates that contributions are sought towards schemes developed through the relevant local Area Transport Strategy.
2.3. The TCP was commended to each of Hampshire's districts following its adoption by the Cabinet. Some of the districts adopted the TCP with immediate effect on the basis of their existing Local Plan policies, whilst other districts chose to ratify the use of the TCP and gain political approval through internal decisions and Supplementary Planning Documents (SPDs). By April 2009, all districts had adopted the TCP apart from East Hampshire District Council.
2.4. Government Circular 05/2005 provides guidance to local authorities on the use of planning obligations. The Circular clarifies the basis on which planning obligations should be assessed in terms of their acceptability against planning policy and provides further guidance on the process of securing obligations. Planning obligations are `intended to make development acceptable which would otherwise be unacceptable in planning terms'. Contributions are secured in order to mitigate the impact of a development or to encourage more sustainable transport practices.
Recent Appeal Decisions
2.5. A number of recent Inspector appeal decisions on small developments in the New Forest and elsewhere have highlighted the need to develop a list of local minor transport improvements and schemes which can be funded by small contributions required under TCP. Concern caused by these decisions has also led to the TCP coming under increased scrutiny, and has highlighted the need to strengthen the Area Transport Strategies of the LTP.
2.6. The majority of the appeal decisions have been for single dwelling proposals in small discrete settlements in the New Forest such as Blackfield and Bransgore, although more recently for an appeal into a major residential development in Totton. The Inspectors have broadly accepted the principle of a tariff type approach to calculating transport contributions (as promoted in Circular 05/2005) and support the general basis and methodology of TCP. They also appear to accept the principle that the cumulative effect of small developments is such that contributions are necessary and justifiable.
2.7. Where appeals have been lost in relation to TCP, it is the lack of sufficient, identifiable and relevant transport schemes on which the contributions can be spent. Although the cumulative impact argument of a number of small developments has been accepted, Inspectors appear to be unwilling to agree that small contributions can be allocated to a general pot for a wider transport strategy. They want to see local schemes which can be linked directly to the development. They believe that these schemes need to have status and a broad outline cost, and that general contributions towards an Area Transport Strategy do not adequately meet all the tests of necessity stated in the Planning Obligations Guidance Circular 05/2005 (as below):
(i) relevant to planning;
(ii) necessary to make the proposed development acceptable in planning terms;
(iii) directly related to the proposed development;
(iv) fairly and reasonably related in scale and kind to the proposed development; and
(v) reasonable in all other respects.
2.8. In some cases the Inspector has seen fit to award costs against the district councils involved. This has caused considerable concern particularly in the New Forest and Winchester City but now also across the County as developers are becoming aware of the Appeal decisions and are challenging the need for a contribution when no relevant scheme is identifiable. Planning authorities are starting to withdraw the requirement for a contribution in such cases where no specific improvement has been identified, potential funding is being lost and the integrity of the Policy undermined.
Methodology for Scheme Identification and Approval
2.9. To ensure that the transport impact of development (including small scale development) is properly mitigated, it is proposed that a directory of transport schemes is coordinated and produced that would sit within and support the current LTP Area Transport Strategies. This would be a first point of reference for Highways Development Control in negotiating and recommending developer contributions, and would provide confidence to district councils in supporting demands for transport contributions. However this will be caveated by the need to include provision within the Section 106 Agreements which secure contributions to allow the developer to use discretion to spend contributions on "any other such schemes as may reasonably benefit the site".
2.10. The first phase of this work will concentrate on collating detail of schemes and programmes that have already been identified and already have some form of acceptance and status as valid schemes within the transport strategy for the area. Collation of this information needs to take place immediately, centrally coordinated within Transport Policy, but with input from:
(i) Area Teams - Transport Policy, Traffic Management and Highway Engineers/Inspectors;
(ii) School Travel Plan Team and Safer Routes to School;
(iii) Passenger Transport;
(iv) Safety Engineering;
(v) ITS;
(vi) Landscape, Planning and Heritage; and
(vii) District Councils (transport officers).
2.11. Following the initial stage (which will remedy short term difficulties with TCP), it is proposed to enhance and develop the scheme lists through consultation with County Members through the Hampshire Action Team (HAT) process to identify further potential schemes, and also through the regular liaison meetings that the Area Transport Teams hold with district authorities.
2.12. Once the schedule of schemes has been drawn up by officers, approval from the Executive Member for Environment will be sought for each list that will be adopted under each of the Area Transport Strategies. This list will be reported to the HATs.
2.13. A GIS database is under development (linked with Excel spreadsheets) to enable simplified retrieval of what will be a significant amount of information. The information will also be used to form an addendum to the Area Transport Strategies, which will provide information on the transport scheme, its location, purpose, estimated construction cost and detail its contribution to the transport strategy objectives.
2.14. The scheme list will be a live list, and continual monitoring and review of the list will be undertaken, coordinated by County Council officers. New schemes will be added when these become identified, and constructed schemes will be removed as appropriate. The HATs will be asked periodically for input into the list.
Winchester City Council Proposals
2.15. Winchester City Council adopted the County Council's new policy for determining and collecting transport contributions to mitigate the impact of new development from 1 April 2008. The TCP was adopted to sit with Policy DP.9 of the Winchester District Local Plan which requires development to provide the necessary social and physical infrastructure, and states that 'reasonable and equitable financial contributions may be accepted in lieu of actual provision'.
2.16. Following the recent appeal decisions, the City Council has sought to discuss the future implementation of the TCP in the Winchester district with County Council officers. The City Council is concerned that without an identified specific improvement scheme related to a development proposal that a financial contribution would fail to meet the tests of Circular 05/2005 and, as such, would not be lawful.
2.17. In accordance with the methodology set out above, officers from both the County Council and the City Council have been developing a schedule of local transport improvements, drawing from County Council sections, previous transport studies and the views of local ward Members and parish councils of Winchester District. County officers have considered the list of schemes and requests submitted, and have sought to put forward only the schemes identified that have sufficient detail and are considered to support the principles of the Area Transport Strategies covering the district. Those schemes determined by officers to have insufficient detail will be considered further over the coming months and additional work undertaken to establish whether they should be included on the list. A draft list of schemes for the Winchester District is attached to this report. The list will be compiled and managed by the County Council but in consultation with each district.
3. Finance
3.1. The continued application of the TCP across the County Council is integral to the County Council maximising financial contributions secured towards transport improvements and services from new development. In the absence of a strong and well supported TCP (which can be consistently defended and justified), less external funding will be collected by the County Council towards transportation improvements, leading to reduction in the Capital Programme and increased strain on existing infrastructure and resources.
3.2. Failure to provide the necessary schemes to support the collecting of financial contributions in accordance with the TCP may result in a number of districts in Hampshire withdrawing the policy (or limiting its application), thereby failing to collect financial contributions and so failing to adequately mitigate the impact of development. This may, in the future, result in the County Council having to fund improvements to infrastructure and services which should have been funded by development.
3.3. Internal staff resources within the County Council will be required to compile the list of schemes set out in this report, and for ongoing management and reporting of the list.
4. Performance
4.1. Having a functioning and robust Transport Contributions Policy will enable both the County Council (in connection with Strategic Planning Applications and County Matters) and District Councils to operate the adopted TCP. It will also enable the County's policy to be better supported when challenged in negotiations, and on appeal.
5. Future direction
5.1. Initial roll-out of the methodology to produce scheme lists for all other districts within Hampshire.
5.2. Executive Member approval of each scheme list to sit within the Area Transport Strategies of the LTP.
5.3. Report of approved scheme list to the HATs (including regular updating).
6. Recommendations
6.1. That approval be given to the methodology set out in this report for the identification of local transport improvement schemes and that this approach be rolled out across all districts in the County.
6.2. That delegated authority be awarded to officers for the continued and future management of the transport scheme lists but with annual reference to the Executive Member for Environment for approval.
6.3. That the draft list of local transport schemes for Winchester be approved and that this list forms part of the Area Transport Strategy.

· The strengthening of the Area Transport Strategies with local transport schemes will improve the ability for transport contributions to be sought across the County, maximising the level of income, and bringing forward improvements to the transport network which encourage the use of sustainable modes of transport, reducing the environmental impact of development.
b) How does what is being proposed consider the need to adapt to climate change, and be resilient to its longer term impacts?
· Maximising the level of transport contributions is vital to ensure that development is supported by sufficient infrastructure and services so to mitigate the impact of the development, encourage access by non car modes and reduce the future impact of development and transport on the environment.
