1 APOLOGIES FOR ABSENCE

2 DECLARATIONS OF INTEREST

Members were mindful that, where they believed they had a personal or prejudicial interest in any matter to be considered at the meeting, they should normally at the time of the debate declare their interest and, having regard to the circumstances described in paragraphs 9, 10, 11 and 12 of the County Council's Code of Conduct, consider whether to leave the meeting whilst the matter was discussed, save for exercising any right to speak in accordance with paragraph 12 of the Code. The declaration should be made at the time of the relevant debate

3 MINUTES

The Minutes of the meeting of the Committee held on 27 May 2009 were confirmed as a correct record and signed by the Chairman.

4 CHAIRMAN'S ANNOUNCEMENTS

The Chairman welcomed both new and returning Members to the Regulatory Committee. The Chairman also reminded Members that it was a requirement of the Council for Members of the Regulatory Committee to receive training from time to time and a short briefing from Officers, which would be particularly useful for new Members on the Committee, had been scheduled at the end of this meeting. A full day training session on planning matters, which all Committee Members would be encouraged to attend, would be arranged in the near future. The Chairman further advised that the current Code of Practice had been reviewed in consultation with Members of this Committee and that he expected that a revised protocol would be agreed by the County Council shortly.

Arising from the County Council elections some vacancies had occurred in respect of the Chairmanship of some of the Liaison Panels. Normal practice was for the Chairman to be the local Member and accordingly the Committee was asked to agree that the following Councillors be asked to Chair the Panels outlined below :-

    The Committee agreed these appointments.

5 DEPUTATIONS

Members were reminded that they had approved a scheme which involved the suspension of Standing Order 21 to allow Members to ask questions of deputees for clarification of facts on an agenda item. Questions from Committee Members would be asked through the Chairman, who might seek the advice of the Committee's legal and other advisers as appropriate. The Chairman's decision on a question would be final. Local Members who requested to speak at the Committee might also be asked questions. The deputations had been notified in respect of Items 6 and 7.

6 CONSTRUCTION OF A NOISE ATTENUATION BUND FOR M27 AT LAND AT CHURCH LANE, NURSLING (APPLICATION NO: 09/00966/CMAS) (COUNTY COUNCIL REF: TV245)

The Committee considered the report of the Head of Planning and Development (Item 6 in the Minute Book) in respect of an application for the construction of a noise attenuation bund for the M27 on land at Church Lane, Nursling.

It was reported that Test Valley Borough Council had subsequently notified objections and that they had expressed concerns in relation to traffic, the visual impact of the construction and whether there was sufficient justification for the proposal.

Councillor Nigel Anderdon, speaking as a Nursling and Rownhams Parish Councillor and also as a local resident made a deputation objecting to the proposal.

Mr. Steve Cole, the Environmental and Development Director of Raymond Brown Minerals and Recycling Limited spoke in support of the application.

Standing Order 21 was suspended to allow questions and clarification of facts to be asked of the deputees.

Members noted the balance of representations received in respect of the application and also that the nearest residents who would benefit most from noise attenuation had registered their objections.

RESOLVED:

That permission for the construction of a noise attenuation bund for the M27 at land at Church Lane, Nursing (Application No: 09/00969/CMAS) be refused for the reasons set out in the report.

Voting : 13 for recommendation, 0 against (permission refused).

7 CHANGE OF USE OF AN AGRICULTURAL BUILDING AND ADJOINING LAND FOR THE STORAGE AND PROCESSING OF BUILDERS WASTE AT HEBERDENS FARM, FINCHDEAN (APPLICATION NO: 22407/009) (COUNTY COUNCIL REF: EH158

The Committee considered the report of the Head of Planning and Development (Item 7 in the Minute Book) in respect of an application for planning permission to change the use of agricultural building and adjoining land for the storage and processing of builders waste at Heberdens Farm, Finchdean.

Members were advised that the application received sought to regularise the current situation and that the site location was within an Area of Outstanding Natural Beauty (AONB).

Councillor Geoff Worthington made a deputation on behalf of Rowlands Castle Parish Council objecting to the proposal. Standing Order 21 was suspended to allow questions of clarification of facts to be asked of the deputee.

Members noted that the report contained a number of minor typographical errors which they did not regard as critical in themselves. They were, however, concerned at the cumulative effect of these errors and whether the report was therefore potentially, albeit unintentionally, misleading. Members also expressed reservations regarding the suitability of the access arrangements to the site. Taking both of these factors into account they indicated that it would be appropriate for a site visit to be undertaken.

RESOLVED:

That the item be deferred to a future meeting of the Committee so that a site visit can be undertaken and matters within the report that need to be corrected can be amended.

8 CONVERSION OF THE EXISTING 3 FORM ENTRY JUNIOR SCHOOL BUILDING INTO 1 FORM ENTRY PRIMARY SCHOOL, WITH THE DEMOLITION OF EXISTING 3 FORM ENTRY INFANT SCHOOL AND PLAYGROUND FOR THE CONSTRUCTION OF A GRASS PLAYING PITCH AT WOODCROFT PRIMARY SCHOOL (FORMERLY MEADLOWLANDS JUNIOR AND INFANT SCHOOL), WOODCROFT LANE, WATERLOOVILLE (APPLICATION NO: 09/59532/002) (COUNTY COUNCIL REF: HVE023)

The Committee considered the report of the Head of Planning and Development (Item 8 in the Minute Book) seeking conversion of the existing 3 form entry junior school building into a 1 form entry primary school.

Councillor John West advised the Committee that up until 4th June 2009, he had been the local County Council Member and that he had publicly indicated that he was in favour of the application. He therefore stated that he would absent himself from the room whilst this application was considered and left the room.

The Head of Planning and Development circulated an additional note to the report containing further information relating to car parking and potential community use. The additional information submitted confirmed that the Headteacher of Woodcroft Primary School was in agreement with the proposed parking arrangements set out in the plans accompanying the application.

RESOLVED:

That planning permission for the conversion of the existing 3 form entry junior school building into 1 form entry primary school, with the demolition of existing 3 form entry infant school and playground for the construction of a grass playing pitch at Woodcroft Primary School (formerly Meadlowlands Junior and Infant School), 35-37 Woodcroft Lane, Waterlooville PL8 9QD (Application No: 09/59532/002) be granted, for the reasons set out in the report (including the additionally circulated note).

Voting : 12 for, 0 against.

9 CONSTRUCTION OF A REPLACEMENT MINI SYNTHETIC TURF PITCH WITH FENCING, FLOODLIGHTING, DRAINAGE AND ACCESS PATHS, HORNDEAN TECHNOLOGY COLLEGE, BARTON CROSS, NEAR WATERLOOVILLE (APPLICATION NO: 21596/014) (COUNTY COUNCIL REF: EHE003)

The Committee considered the report of the Head of Planning and Development (Item 9 in the Minute Book) seeking planning permission to construct a new replacement mini synthetic turf pitch with fencing, floodlighting, drainage and access paths at Horndean Technology College, Barton Cross, near Waterlooville.

The Committee was advised that Councillor Sam Payne, newly elected County Councillor Member for the ward within which the school was located, supported the application. Members were also advised that three additional letters of representation (not objection) had been received.

In respect of the potential for balls to be kicked against the fencing and the potential disturbance this might cause to local residents, Officers advised that it would be appropriate to include an informative in the conditions for the permission. The school would therefore be encouraged to include in their management plan a reference to controlling this practice.

RESOLVED:

That planning permission in respect of the construction of a replacement mini synthetic turf pitch with fencing, floodlighting, drainage and access paths at Horndean Technology College, Barton Cross, Near Waterlooville (Application No: 21596/0124) be granted subject to the conditions in Appendix B of the report and the additional inclusion of an informative regarding balls being kicked against the perimeter fencing.

10 PROPOSAL TO RECORD A PATH BETWEEN SALISBURY ROAD AND WHINWHISTLE ROAD IN COPYTHORNE PARISH AS A PUBLIC RIGHT OF WAY

The Committee considered the report of the Director of Culture, Community and Rural Affairs (Item 10 in the Minute Book) on a proposal to record a path between Salisbury Road and Whinwhistle Road in Copythorne Parish as a public right of way. Members noted the historic origins of the route but also noted that any historic rights for mechanically propelled vehicles were extinguished in 2006.

RESOLVED:

That an Order be made to record Route A-B (as shown on the map attached to the report) on the definitive map of public rights of way as a restricted by-way, with the path to have a width of 3.0 metres.
