1. The decision: (PROPOSED)
a) That approval be given to the land transactions set out in the report to enable the proposed West Tytherley CE (C) Primary School drainage scheme to proceed, and that the Director of Property, Business and Regulatory Services (Strategic Manager - Assets and Development) be authorised to settle the details of the terms and conditions (including third party professional fees).
b) That approval be given to the payment of the professional fees to the owners of two nearby properties, together with the legal fees of the Winchester Diocesan Board of Finance, in respect of an aborted proposal for a new school drainage scheme and the Director of Property, Business and Regulatory Services (Strategic Manager - Assets and Development) be authorised to settle the final amount.
c) That the earlier decisions to take an easement and a lease from two nearby owners be rescinded.
2. Reason for the decision:
2.1. A replacement drainage system for West Tytherley CE Primary School is required as the existing system located in a nearby third party property has reached the end of its useful life. Consultations with the Environment Agency led to a number of schemes being investigated, one of which involved the land of nearby owners, which reached the stage of Member approval and legal work being undertaken. The Environment Agency has now changed its views on the outfall from the scheme and therefore a further drainage system is proposed retaining the majority of the drainage system on the school site and the previously approved scheme is to be abandoned. This proposal is linked to the Corporate Strategy as it will enhance the quality of the environment.

3.1. Like-for-like replacement of the existing system in the third party property.
3.2. Provision of a sewage treatment plant and soakaway system within the school site.
3.3. Sewage treatment plant and soakaway system on other nearby owners' land.
