1) Executive Summary
1.1. The purpose of this report is to seek approval by the Executive Member for Policy and Resources to a number of new procurement initiatives and provide Members with an update on the procurement initiatives identified in the report to the Panel in March 2009 and approved by the Executive Member for Policy and Resources on 9 April 2009.

2) Contextual Information:
2.1 The Executive Member for Policy and Resources approved on 9 April 2009 the annual review of construction related procurement for 2008/9 and a number of new initiatives to be implemented over the current financial year and beyond.
2.2 The completion of projects and programmes of work through framework and term contract arrangements ensures that schemes and programmes of work are delivered in a cost-effective way, involving closer working and collaboration with the construction industry which contributes to continuous improvement in the County Council's services and enhances the quality of place in Hampshire.
3) Extension of pilot partnership with MACE
3.1 In October 2006, Cabinet approved the establishment of a partnership arrangement with a private sector organisation to provide the capacity required to support the County Council's leadership of the building workstream of the South East Centre of Excellence (now Improvement and Efficiency South East (IESE)). A pilot partnership with MACE was subsequently approved by the Executive Member for Policy and Resources in July 2008. The partnership arrangement has involved a small number of construction professionals being seconded to the County Council from MACE through the IESE Tier 1 framework. The Executive Member for Policy and Resources approved on 16 October 2008 a 6 month extension to the pilot arrangement.
3.2 An internal review of the pilot arrangement was undertaken in late 2008, which showed that the partnership is proving highly effective in contributing to the County Council's success in leading the IESE workstream. The review identified that the partnership had provided the capacity required to respond to the opportunities presented by IESE and that MACE had provided specialist skills in areas such as project and supply chain management which complemented the skills available within the County Council.
3.3 It is now proposed to further extend the pilot partnership until the end of the 2009/10 financial year. The pilot partnership is an interim arrangement and will be superseded by the procurement of a long term strategic partner(s) in conjunction with the development of a trading company as outlined in the proposals from the Corporate Service Review of Property Services.
3.4 The approximate cost of extending the pilot partnership is £490,000. These costs are funded through the approved IESE funding and involve no cost to the County Council. The appointment will be through the new IESE Consultancy Framework which will reduce the unit costs by approximately 15%. (Savings as a result of procuring a region-wide framework).
3) Building Schools for the Future ICT Managed Service Framework
3.1 As identified in the Major Projects Update report found elsewhere on the agenda, development of a strategy for a managed ICT service is an integral part of the change management and investment programme for the Building Schools for the Future (BSF) programme. Partnership for Schools (PfS) and the Department for Children Schools and Families (DCSF) consider ICT to be central to the transformation vision of any BSF project and the development of a model for early selection of ICT providers and contractors is essential for the success of the complementary procurement strategy.
3.2 The Readiness to Deliver Statement submitted to PfS earlier this year identified proposals to procure a panel of ICT providers under a framework agreement available to other local authorities as part of the Regional Education Partnership (REP) approach. The County Council will work with one of these providers to deliver an area wide ICT managed service for the first wave of BSF projects in Havant.
3.3 Work is currently ongoing with schools, Children's Services, IT Services and other local authorities, as part of the development of the Strategy for Change, to determine the scope and structure of the ICT managed service arrangement. Further consultation is also required with PfS to agree the detailed scope and structure, however it is anticipated that it would comprise a minimum of 3 providers with the provider for a particular local authority selected through a call-off process.
3.4 To facilitate the early selection of ICT providers in line with the County Council's overall programme for delivery of the BSF projects in Havant, it is anticipated that procurement of the framework, through an OJEU tendering process, will commence prior to PfS approval of the Outline Business Case.
3.5 The estimated value of the ICT managed service for the County Council's BSF projects in Havant is £7.5 Million.
4) Flood Damage reinstatement works at Wellstead Primary School
4.1 On the 21 July 2009, a Southern Water main on the Dowd's Farm residential development in Hedge End burst causing severe flooding and damage both internally and externally to Wellstead Primary school. The school is a new building, completed in summer 2008 and still in the defects liability period at the time of the flood.
4.2 Emergency actions to secure the site and address the immediate problems were undertaken with the County Council's term contractor, Tew Brothers Limited. The original contractor for construction of the new school, BAM Construction, were due to be on site over the summer holiday period to undertake some additional works. It was therefore agreed that BAM Construction would undertake the required clear up and flood damage repair works as an addendum to the original construction contract at a cost of approximately £425,000.
4.3 Works progressed well over the summer period and the school was able to open again at the beginning of the autumn term. This was a significant effort by the contractors and HCC team to deliver this in such a short period.
4.4 The total estimated cost of the flood damage is £570,000. Steps are in place to recover these costs through our legal services from Southern Water.
5) Contractor Pre-Construction Appointments
5.1 The County Council's procurement strategy for building construction projects includes the procurement of major projects through the IESE Tier 1 and Tier 2 frameworks. These framework arrangements are based on the selection and appointment of the main contractor early in the design phase of the project to work as part of the project team. The contractor provides a range of pre-construction services including advice on buildability, cost planning, package procurement and construction planning and programming, for which the contractor is paid a pre-construction fee. On some projects the pre-construction fee includes for the contractor to develop the design using its own team of design professionals.
5.2 To ensure that the contractor's input can be used to advantage on the project, the appointment is normally made prior to approval of the project appraisal. Award of the construction contract is not completed until after project appraisal, once the procurement process has been completed.
5.3 The following projects have been identified for development and procurement through the IESE Tier 1 and Tier 2 frameworks and approval is therefore sought for selection and appointment of contractors to provide pre-construction services prior to approval of the project appraisal:

6) Procurement Initiatives - progress and update
6.1 To date this financial year, approximately £30 million of construction and maintenance work has been contracted by the department on behalf of the County Council. Projects have been delivered through a range of procurement routes including:
· £6.4 million of work procured through the IESE Tier 1 framework, with a further £4.4 million currently under design development.
· £6 million procured through the IESE Tier 2 framework with a further £5 million identified for design development.
· £2.8 million procured through the IESE Tier 3 framework with a further £6.5 million of work allocated.
· £0.4 million of work procured through the hard landscaping framework.
6.2 Since the report to the Panel in March 2009, contracts for the new reactive maintenance arrangements have been awarded, with Tew Brothers Ltd appointed for two area based contracts and the out of hours service and Rok Building Ltd appointed for the remaining area based contract. The new contracts have been implemented on a phased basis over the summer and are now fully operational.
6.3 Two consultant frameworks have also recently been concluded. JMP Consultants Ltd has been appointed to the 4 year framework for Transport Planning Services and Capita Symonds Ltd have been appointed to the 4 year framework for provision of CDM Coordinator Services.
6.4 Details of these frameworks and projects procured through or allocated to the IESE framework arrangements are provided at Appendix C.
6.5 Good progress has been made with implementing e-tendering during the last few months. Since April this year more than 60% of tenders issued by Property Services have been via the County Council's e-tendering system, In-Tend. The e-tendering system offers efficiencies including reduced photocopying, postage and administrative time preparing and issuing multiple hard copies of tender documents.
6.6 Property Services has also introduced new electronic contract software, JCT On-line, which allows quicker preparation of contract documents.
7) Improvement and Efficiency South East - progress and update
7.1 The County Council has continued to lead the Construction and Asset Management Theme on behalf of IESE. Earlier this year, the team was successful in attracting funding of just under £1.3m for the 2009 / 2010 financial year, to continue the work on the projects reported to the Panel on 31 March 2009.
7.2 Since the March 2009 report, more of the regional and sub regional procurement arrangements have become available and are now contributing to the efficiency targets for the construction and asset management theme. The regional consultants framework, which was developed in conjunction with the Office of Government Commerce (OGC), was launched in June 2009.
7.3 Since the start of the regional construction framework in July 2006, the regional and sub regional arrangements have realised over £17m in efficiency savings to date. The shared services and asset management programme is leading high profile projects with at least five authorities, three of which are in Hampshire.
7.4 The success of the arrangements has been a major factor in attracting further funding. Earlier this year, the Local Government Minister invited Hampshire County Council to put forward a proposal to form a National Improvement and Efficiency Partnership for construction, and this proposal has subsequently received grant funding support of £250,000 with a further £250,000 pledged from the Regional Improvement and Efficiency Partnerships (RIEPs) and other government agencies. The National Partnership is chaired by Andrew Smith and recently featured in the September issue of the Local Government Chronicle (Appendix D). The aims of the Partnership are to:
_ Build on the work of individual RIEPs
_ Create a clear vision on how local and central government could collaborate to deliver national construction programmes alongside local benefits.
_ Provide leadership for construction related activity and an intelligent interface with the sector.
_ Provide an integrated approach to harnessing all key stakeholders e.g. Constructing Excellence, the private sector and key government departments and agencies (DCSF, OGC).
7.5 Recently, following a bid for further grant funding through IESE against an Efficiency and Transformation fund, the Construction and Asset Management theme has been awarded a further £470,000 to scope and plan six projects as follows:
· property and asset rationalisation, working with authorities to realise efficiencies in the management of their property portfolio;
· regional/sub regional approaches to maintenance and facilities management;
· regional/sub regional frameworks for highways capital works or local transport plan;
· further supply chain development to deliver aggregation efficiencies for commodities or packages of work;
· common training and development courses for property or environment professionals across the region;
· provision of a project manager to lead three district authorities and an NHS trust in the development and procurement of three leisure centres with health provisions.
7.6 IESE has also been awarded £130,000 from the Department for Transport (DfT) to carry out regional work in the areas of highways procurement and asset management, which will be used to develop existing projects in these areas with colleagues in the Environment department.
7.7 The total current funding for 2009 / 2010 including the IESE budget, Efficiency and Transformation funding, and DfT support is just under £2m. In addition there is currently £250,000 funding for the National Partnership, with expectations of a further £250,000.
8) Conclusion
8.1 The procurement decisions set out in this report comply with the Public Procurement Regulations 2006 and the Council's Contract Standing Orders. The proposals are also in line with the procurement model and strategy for building construction work approved by the Executive Member for Policy and Resources on 9 April 2009.
9) Recommendations:
That the Panel advises the Executive Member for Policy and Resources that:
9.1 The trial partnership with MACE be extended until the end of the current financial year at an estimated cost of £490,000.
9.2 The proposals to commence procurement of a regional framework for an ICT Managed Service as part of the Building Schools for the Future programme be approved.
9.3 Selection and appointment of 2 or 3 contractors under the IESE Tier 1 framework to provide pre-construction services up to a maximum value of £250,000 per contractor in connection with the BSF projects in Havant be approved.
9.4 Selection and appointment of a contractor under the IESE Tier 1 framework to provide pre-construction services up to a maximum of £100,00 in connection with the Havant Public Service Village be approved.
9.5 Selection and appointment of a contractor under the IESE Tier 1 framework to provide pre-construction services up to a maximum of £100,000 in connection with the Runways End Youth Adventure Centre project be approved.
9.6 Selection and appointment of a contractor under the IESE Tier 2 framework to provide pre-construction services up to a maximum value of £30,000 in connection with the community and health provision project at Park Community School be approved.
9.7 Selection and appointment of a contractor under the IESE Tier 2 framework to provide pre-construction services up to a maximum value of £50,000 in connection with work to swimming pools at Bishops Waltham Junior school, Locks Heath Junior school, Mill Rythe Junior school and Fernhill Primary school be approved.
9.8 Selection and appointment of a contractor under the IESE Tier 2 framework to provide pre-construction services up to a maximum value of £50,000 in connection with the re-cladding of two ROSLA buildings at Fernhill School and Language College and Quilley School of Engineering be approved.

Race and equality impact assessment has been considered in the development of this report and no adverse impact has been identified.
Crime prevention issues
The County Council has a legal obligation under Section 17 of the Crime and Disorder Act 1998 to consider the impact of all the decisions it makes on the prevention of crime. The proposals in this report have no impact on the prevention of crime.
How does what is being proposed impact on our carbon footprint / energy
consumption?
All new build projects will meet current standards for carbon and energy consumption. Refurbishment projects will generally see a reduction in energy consumption through incorporation of higher design standards with particular emphasis on increased insulation, air tightness, thermal mass, passive ventilation and reducing solar gain in order to reduce the need for mechanical ventilation. Projects also seek to incorporate efficient building services equipment and controls.
How does what is being proposed consider the need to adapt to climate
change, and be resilient to its longer term impacts?
Current design standards used by Property Services seek to reduce reliance on mechanical ventilation and therefore reduce energy consumption by using passive ventilation strategies with a focus on increasing thermal mass, insulation and air tightness and reducing solar gain. Efficient building services equipment and intelligent building services controls are used to support this approach. Approaches such as sustainable urban drainage (SUDs) and on site surface water storage are also considered in the design to address flood risk issues.
