1. Executive Summary

1.1. The purpose of this paper is to introduce a revised draft constitution for the Hampshire SACRE which will incorporate statutory amendments and the broader remit for the SACRE in Hampshire.

2. Contextual information

2.1. The Education Act 1996 replaced the Education Reform Act 1988 as the primary legislation in relation to the make up and duties of the SACRE. Whilst no further guidance has been issued in relation to SACREs themselves, there has been subsequent legislation and guidance requiring the promotion of community cohesion.

2.2. The revised constitution for the Hampshire SACRE is attached at appendix 1 and reflects these various legislative changes.

3. Finance

3.1. There are no financial implications.

4. Other key issues

4.1. In addition to the required updates to reflect the current statutory requirements, the document reflects the specific commitment on the part of the County Council to work with the Hampshire SACRE to promote community Cohesion.

4.2. The provisions relating to membership are largely specified in the legislation however the use of a standing substitute member for each group has been introduced to reduce the possibility that any group may find itself inquorate. The requirement that any substitute should be properly informed of any issues is intended to avoid the need to revisit previous discussions and to ensure that decisions are made on a fully informed basis.

4.3. The provisions in relation to voting are unchanged. However the revised document highlights the need for each group to be quorate, with a requirement that a minimum of one third of the representatives of each group must be in attendance at the meeting (either personally or by way of the substitute member).

4.4. The provisions in relation to the selection and appointment of the Chairman and Vice Chairman have been broadened and include the provision that the SACRE may, by agreement, nominate an individual from its membership for the position of either Chairman or Vice Chairman. The decision remains with the Local Authority as the SACRE is a standing committee of the County Council.

4.5. The Hampshire SACRE has been consulted on the draft document. One minor amendment was proposed but the wording reflects the statutory provision and accordingly the recommendation is that it should remain

5.1. That the Executive Lead Member for Children's Services approves the revised constitution as set out in appendix 1.
