Overgrown vegetation letter/notice
If you have received a letter about overgrown vegetation, you should update your enquiry as requested.
Vegetation clearance standards
The vegetation needs to be cut back behind the boundary of your property so that it does not encroach onto the highway (which includes a road, pavement or verge), allowing for subsequent seasonal growth.
Where the vegetation on your property overhangs the highway, the minimum height clearance required is:
- 2.3m above pavements and verges
- 2.4m above cycleways
- 5.2m above roads
Tree Preservation Orders (TPOs)
Before undertaking any tree work, consult your local city or district council. Approval may be required if the tree is protected by a preservation order or located in a conservation area.
Wildlife protection and nesting birds
Vegetation maintenance should be planned outside of the bird nesting season, typically in the summer. The Wildlife and Countryside Act 1981 protects wild birds’ nests and eggs from damage or disturbance. Exceptions exist, particularly if public safety is at risk.
As long as no active nests are moved or damaged, you can legally cut vegetation year-round.
We only request the cutting back of overgrown vegetation when it has an impact on public safety.
