Regulation 22 - Submission of Documents to the Secretary of State

Hampshire County Council and its partner Authorities, Southampton City Council, Portsmouth City Council, New Forest National Park Authority and South Downs National Park Authority (collectively known as the Hampshire Authorities), are working to produce a partial update to the Hampshire Minerals and Waste Plan (the Plan) which will guide minerals and waste decision making in the Plan Area up until 2040.

The partial update to the Plan will build upon the currently adopted Hampshire Minerals and Waste Plan (2013), eventually providing new and updated policies based on up-to-date evidence of the current levels of provision for minerals and waste facilities in the Plan Area. Importantly, the partially updated Plan aims to establish the future levels of provision required to meet national and regional policy targets and objectives. It will set out an updated vision of how this will be achieved and provide details of strategic sites that we propose will deliver the vision.

The Hampshire Authorities are now submitting the plan for independent examination, under Regulation 22 of the Town and Country Planning (Local Planning) (England) Regulations 2012 (as amended).

To date, several information gathering exercises and a public consultation have been completed to inform the Plan, under Regulation 18 (of the Local Planning (England) Regulations 2012) between 2021 and 2023.

The Proposed Submission Plan was consulted on for eight weeks, beginning on 9 January 2024 and ending 5 March 2024. The Proposed Submission Plan, the evidence base and all representations received are being submitted to the Secretary of State for independent examination.

Update

Following submission, it was brought to our attention that a small number of issues raised in a Regulation 19 response had not been included in Annex 2 of the Consultation Statement (Regulation 22). Following a review, this was confirmed. While Annex 2 is an optional addition to the Consultation Statement and the Planning Inspector will have all the full responses at their disposal, it was considered that an Errata document would be beneficial to address this point and others, where relevant. It also provided the opportunity to improve signposting of some of the existing comments, include those of support where these had not been set out, ensure all comments were attributed to relevant organisations and where necessary, include issues where it was felt they could be better articulated.

The Planning Inspectorate was contacted, and it was agreed by the Inspector that we should proceed with this approach.

The amendments to the Consultation Statement do not propose any material changes to the policies or proposals, and therefore, would not have altered the recommendation for the Plan to be submitted for examination. The summary of main issues provides an early understanding for the Inspector of the issues that are likely to need to be addressed as part of the examination.

All Regulation 19 consultation responses have been submitted to the Inspector as required for review and the Errata document is now available on the Examination Library and as a hard copy as set out below.

What happens next?

The Inspector

The Secretary of State will appoint a Planning Inspector to carry out an independent examination of the Hampshire Minerals and Waste Plan – Partial Update. The Inspector’s task will be to consider the soundness and legal compliance of the submitted Plan, based on the criteria set out in paragraph 35 of the National Planning Policy Framework 2023 (the Framework) and associated regulations, such as the Planning and Compulsory Purchase Act 2004, the Localism Act 2011 and the Town and Country Planning (Local Planning) (England) Regulations 2012.

The Inspector will take into account the representations submitted upon the Submission Plan as far as they relate to soundness considerations. A number of informal debates will take place on the principal matters identified by the Inspector - these are termed Hearing Sessions.

At the end of the Examination, the Inspector will prepare a report to the Hampshire Authorities with precise recommendations, these recommendations may include modifications to the Plan, if such a request is made by the Hampshire Authorities.

Hearing Sessions

Hearing Sessions will be announced at a later date, at least 6 weeks before the opening of the hearings.

The Planning Inspectorate have produced a procedural guide, aimed at all those involved in the process and concerned with the procedural aspects of examining a Local Plan.

The Planning Inspectorate have also produced a short guide, aimed at those who might be participating in a local plan examination for the first time.

The Programme Officer

The Programme Officer will act as the contact for any person who has an interest in the Examination and as a liaison between the Inspector, Authority and Representors. They are an independent Officer of the Examination and work on behalf of the Inspector to organise and manage the administrative and procedural elements of the Examination process.

Any queries people may have regarding the Examination process should be directed to the Programme Officer, who will be happy to assist.

Any matters that anyone wishes to raise with the Inspector should be submitted via the Programme Officer.
