Information for Employers on McCloud

Employer Data Requirements

To remedy McCloud, employers were required to provide Hampshire Pension Services fully completed data sets for the period of 01 April 2014 to 31 March 2022. All data sets received have now been uploaded to members records where possible. 

Employers who are still to provide data to Hampshire Pensions should continue to prioritise and ensure this is sent urgently. 

What Happens Next?

Over the coming months we will continue to deal with any data cleansing and will be reviewing members who are eligible for McCloud. Eligible members will have this information reflected in their 2025 Annual Benefit Statement. 

Leavers - when providing a leaver form, you should provide (or check on the Employer Hub) the full-service history up to 31 March 2022, regardless of providing this as part of any McCloud data submissions. This is to ensure that we reflect McCloud correctly in any leaver calculations, including those for retirements, while we continue to cleanse the data using submissions received. 

What to tell members

If a member is unsure if they will be impacted by McCloud they can do an initial check on the LGA website which has a guide to who is affected. This will help a member work out if they are eligible for McCloud. 

Please see below guidance on what advise members based on their record status:

Active but not near retirement - Wait until McCloud is added to the ABS released in August 2025.

Active but planning to retire - Members should check their service on the Member Portal and run an online estimate. If retiring within 18 months, they can request an estimate from our retirements team. They should note only one free estimate in a 12 month period (per pension account) can be provided by the team. There will be charges for additional estimates.

Deferred but not near retirement - Wait until McCloud is added to the ABS released in August 2025

Deferred but wanting to retire - Members should check their service on the Member Portal and run an online estimate. If retiring within 18 months, they can request an estimate from our retirements team. They should note only one free estimate is given in a 12 month period (per pension account). There will be charges for additional estimates provided by the retirements team.

Pensioners - We will be prioritising all pensioner recalculations and will be touch with any members affected by McCloud.

TPS McCloud remedy and the LGPS
The implementation of the McCloud remedy in the Teachers’ Pension Scheme (TPS) means that some teachers will be retrospectively eligible for the LGPS for the period from 1 April 2015 to 31 March 2022. 

In the TPS there are different rules if a teacher has a full-time contract and an additional part time contract, depending on which scheme arrangement a member is in.  For these purposes, the additional part-time contract is referred to as ‘excess service’.  This doesn’t occur if a teacher has multiple part-time contracts, even when they excess 365 days.  

The McCloud transition protection changes which have been introduced will affect anyone with excess service during the remedy period.  More information on the background to this and how the remedy will be applied can be found in the LGA Bulletin 229 or the TPS website
 
Process update
The TPS webpage ‘Managing LGPS linked excess service’ sets out a brief summary of the process for teachers with excess service.

Employers affected by this will now have been contacted and will be validating the excess service data TPS has provided to them.  Some employers have now completed that step and are ready to move on to step 5 to provide data to the administering authority.
Collecting data from Employers

Hampshire Pension Services (HPS) will need to collect employer data in order to set up a pension record for members who will be rolled back to the LGPS.  Members in this group will be protected by the underpin, so we will need to collect both CARE and final salary information for the remedy period.

TPS is currently finalising a spreadsheet so that the Administering Authority can collect employee and employer contributions directly from TPS.  Before we are able to confirm the information, we need from you as an employer we need to wait for a copy of this spreadsheet to reduce the likelihood of errors and additional follow up queries.  

TPS is working on the details of the next stages of the process. We will provide further updates and more detailed guidance on this webpage as final decisions are made.
